AMENDMENT TO EASEMENT AGREEMENT <br /> FOR SANITARY DISPOSAL SYSTEM <br /> This Amendment is entered into this D day of December, 2017, by and between <br /> Golden Green Properties LLC ("Golden Green") and Frank L. Knipfer and Kevin F. Knipfer <br /> (collectively"Knipfer"). <br /> RECITALS <br /> WHEREAS, Golden Green is the owner of Lot 1 of Dane County Certified Survey Map <br /> No. 11192 ("CSM"),which was recorded in the Dane County Register of Deeds office in Volume <br /> 67 of Certified Survey Maps, Pages 242-245 as Document No. 3973924 (the "Golden Green <br /> Property"). <br /> WHEREAS, Golden Green is the successor in interest to the Golden Green Property by <br /> virtue of its purchase of the same by land contract from Marvin K. Tomlinson and Annette M. <br /> Tomlinson ("Tomlinson"). The land contract was executed on or about April 29, 2015, and was <br /> recorded in the Dane County Register of Deeds office on May 30,2015 as Document No.5147294 <br /> and was assigned to the Marvin K. and Annette M.Tomlinson Revocable Trust dated January 23, <br /> 2014 by Assignment of Land Contract, which was recorded on June 24, 2015 in the Dane County <br /> Register of Deeds office as Document No. 5162491 ("Land Contract"). <br /> WHEREAS, Knipfer is the owner of Lot 2 of the CSM (the "Knipfer Property"). Knipfer <br /> acquired the property on or about November 23, 2004 from Tomlinson. <br /> WHEREAS,as a condition ofKnipfer's purchase of the Knipfer Property from Tomlinson, <br /> Knipfer and Tomlinson entered into an Easement Agreement for Sanitary Disposal System dated <br /> November 23, 2004, which was recorded in the Dane County Register of Deeds office as <br /> Document No. 3999083 ("Septic Easement"). Pursuant to the Septic Easement, the Knipfer <br /> Property was granted a nonexclusive right, privilege and easement to place, use, repair, replace <br /> and maintain a septic field on, under and across a portion of the Golden Green Property for the <br /> purpose of maintaining a septic field. <br /> WHEREAS, Golden Green wishes to redevelop the Golden Green Property and Knipfer <br /> has agreed to move the easement area as set forth and described in the Septic Easement. <br /> NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of <br /> which is hereby acknowledged, the parties hereto do hereby agree and covenant as follows: <br /> 1.
