Re-Noticed from the February 28, 2008 Board of Adjustment Public Hearing: <br /> Appeal by Michael & Linda Orr (Axley Brynelson LLP, agent): Appeal for a variance from removal <br /> or replacement of more than 50% of a pre-existing structure, as provided by Section 10.23(4), <br /> Dane County Code of Ordinances (DCCO), to permit proposed alterations to existing boathouse at <br /> 1966 Quam Point Road, being Lot 6 and East Half Lot 7, Addition to Ole J. Quam's Park, Section <br /> 25, Town of Dunn. (Note: A request to resubmit an appeal for a variance from maximum <br /> permitted height of a boathouse as provided by Sections 11.03(3) and 10.07(3), DCCO, within one <br /> year from the date of denial of previous Appeal 3504 on November 15, 2007, on grounds of new <br /> evidence or proof of change of conditions was denied by the Board of Adjustment on February 28, <br /> 2008.) <br /> COMMUNICATIONS: March 18, 2008 Letter from Michael and Linda Orr (received by the Zoning <br /> Division March 20, 2008), withdrawing Appeal 3517. <br /> Schutte reported that the property owners met with her and Zoning Administrator Roger Lane on <br /> March 12, 2008 to identify alternatives for using or replacing the existing boathouse without variances. <br /> They have agreed to work with Zoning and Shoreland Ordinance requirements, and either remodel <br /> the existing boathouse as permitted, or construct a gazebo or screen house as a complying "minor <br /> structure" instead. No Board action was required for Appeal 3517. <br /> 2. Appeal 3521. Appeal by Julie & Stefan Swartzmiller for variances from minimum required lot <br /> width at the building setback line for an existing platted lot in the Shoreland district and minimum <br /> required rear yard as provided by Sections 11.03(1), 10.05(4), and 10.06(8), Dane County Code of <br /> Ordinances, to permit proposed removal and replacement of an existing single-family residence at <br /> 4338 McConnell Street, being Lot 8, Waucheeta, Section 05, Town of Dunn. <br /> COMMUNICATIONS: Town of Dunn: 01/07/2008 Acknowledgement; 03/18/2008 The Town Board <br /> recommended approval of the variance from rear lot line; also, the Town received a letter of support <br /> "from the neighbor to the north who is most affected." <br /> 03/18/2008 Letter submitted by and addressed to owners, from Kevin Magee, 3094 Waucheeta Trail <br /> (owner of abutting property to the north), declining to sell the Swartzmillers any land. <br /> VARIANCES REQUESTED: Purpose: Remove and replace single-family residence on existing <br /> substandard Shoreland lot. <br /> Lot Width Variance <br /> Minimum lot width at building setback line required: 100 feet. <br /> Actual lot width: 20.00 feet at building setback line. <br /> VARIANCE NEEDED: 80.00 feet. <br /> Rear Yard Variance: <br /> Minimum rear yard required: 35 feet. <br /> Proposed rear yard setback: 10 feet. <br /> VARIANCE NEEDED: 25 feet. <br /> IN FAVOR: Stefan and Julie Swartzmiller, Madison, WI <br /> Doug Kornetzke, Madison, WI <br /> OPPOSED: None <br /> ZONING ADMINSTRATOR COMMENT: None, as reported by Schutte. <br /> Note: Hamre left the meeting at 7:30 p.m. to attend the Capital Area Regional Planning Commission <br /> (CARPC) meeting.
