DANE COUNTY ORDINANCE AMENDMENT NO. 8623 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Cottage Grove. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Cottage Grove be amended to include in the A-B Agricultural <br /> Business District/s the following described land: <br /> PETITION NUMBER: 8623 <br /> Part of the NE 1/4 SW 1/4 and the NW 1/4 SE 1/4 all in Section 31, Town of Cottage <br /> Grove described as follows: Commencing at the West quarter corner of said Section 31; <br /> thence N88°44'29" East along the North line of the of the SW 1/4 of said Section 31, <br /> 1570.40 feet; thence S00°54'36" West 1271.42 feet to a point of curvature; thence <br /> Southeasterly 19.00 feet along a curve to the right which has a radius of 60.00 feet and a <br /> chord bearing of S50°36'53" East, 18.92 feet; thence N88°01'36" East, 383.15 feet to the <br /> point of beginning; thence NO2°34'39" West, 135.00 feet; thence N88°01'36" East, <br /> 155.00 feet; thence S02°34'39" East, 135.00 feet; thence S88°01'36" West, 155.00 feet to, <br /> the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> 1111, DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the <br /> owner or owners of the land shall record the following restrictions on said land: <br /> 1) Deed restriction limiting the uses of this parcel exclusively to: <br /> a. Potting, growing and maintaining plants <br /> b. Storing potting supplies <br /> c. Storing and servicing farm equipment such as tractors, a bobcat and <br /> implements for use in the production of nursery stock. <br /> 2) No retail sales can be conducted on this property. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as <br /> the owners of land within 300 feet of the site. Failure to record the restrictions will cause <br /> the rezone to be null and void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
