Appeal 3481. Appeal by Gregory Riemer for variances from minimum lot area and maximum lot <br /> coverage in the Shoreland district as provided by Sections 11.03(1) and 10.05(4), Dane County Code <br /> of Ordinances, to permit proposed detached residential garage at 2038 Catlin Place, being Lots 14, <br /> 15 and 16 and the southerly 2 feet of Lot 13 Block 6, Lake Forest, Section 34, Town of Madison. <br /> COMMUNICATIONS: <br /> May 7, 2007 Letter from Rick Rose, Director of Public Works, Town of Madison, indicating that <br /> Reimer informed the Town of his variance appeal, and stating that "[t]he Town Plan Commission and <br /> Town Board will consider this variance request prior to the [BOA] Public Hearing date." <br /> June 5, 2007 Letter from Rose at Town of Madison, confirming approval of Reimer's variance request <br /> at the 05/31/2007 Plan Committee meeting and the 06/04/2007 Town Board meeting. <br /> VARIANCE REQUESTED: <br /> Needs variance of 3260 square feet from minimum 15,000 SF lot area required in the Shoreland <br /> district. (Actual lot area = 11,740 square feet.) <br /> IN FAVOR: Gregory Riemer <br /> OPPOSED: None <br /> Motion: Klopp/Reynolds to grant variance of 3,260 square feet from the minimum 15,000 square feet <br /> of lot area required in the Shoreland district for sewered lots to permit construction of a new detached <br /> garage. <br /> Finding of Fact: <br /> 1. Riemer owns a property with his single-family residence, consisting of 3 full lots and a narrow strip <br /> of a fourth lot in the Lake Forest subdivision, platted in 1919. The total lot area is 11,740 SF, with <br /> more than 100 feet of lot width on the Martin Street and the Catlin Place sides of the corner lot. The <br /> property is in the Shoreland district, 700+- feet south of the Lagoon connected by Murphy's Creek to <br /> Lake Wingra. <br /> 2. Riemer proposes to build a detached garage on his westernmost lot. When he discussed this with <br /> Zoning Division staff last fall, he was required to record a Deed Restriction approved by the Zoning <br /> Administrator combining all the individual lots and parts of lots for Zoning purposes, because the R-3A <br /> Residential district does not permit an accessory building on a separate lot without a house. <br /> 3. After experiencing some delays related to Zoning Division policies, Reimer recorded the necessary <br /> Deed Restriction; he decided to wait until early 2007 to obtain the Zoning Permit for the detached <br /> garage. In the interim, the Board of Adjustment took action on Appeal 3437. As a result, Reimer's <br /> previously "grandfathered" lots must meet the minimum lot area requirement of the R-1 Residential <br /> district, rather than the less restrictive requirements of the R-3A district. <br /> 4. Reimer's lots meet the minimum 100 feet lot width requirement for a sewered lot and his proposed <br /> house and garage will apparently meet the maximum 35% lot coverage for a corner lot.
