Dane'County Board of Adjustment Minutes Page 4 of 15 <br /> June 28,2007 <br /> Setback from Ordinary High Water Mark (OHWM): Needs variance of 5 feet. (Average of neighbors' <br /> setbacks = 27 feet minus proposed setback 22 feet.) <br /> IN FAVOR: <br /> Jack and Gaye Scheidegger, owners <br /> Marvin Hansen, P.E., Royal Oak Engineering, agent <br /> OPPOSED: None <br /> Finding of Fact: <br /> 1. Existing 36 feet wide sewered lot in Shoreland area of Lake Kegonsa has one-story single-family <br /> residence with enclosed porch (837 square feet (SF) overall footprint); also small shed (38SF+-) <br /> encroaching into Barber Drive right-of-way (ROW). The existing house does not meet the west side <br /> yard setback. <br /> 2. Owners propose to remove existing house (which has no garage) and shed, then build a new 2- <br /> story, 3-bedroom house with attached garage (1259 SF overall footprint). Proposed house would <br /> meet lot coverage requirements, front setback and minimum sideyards. <br /> 3. Enclosed porch of existing house is located approximately 12 plus or minus (+-) from OHWM. <br /> Average of neighbors' setbacks is 27 feet using the nearest walls of the houses on each side. <br /> Proposed house would be 22'+- feet from OHWM. <br /> 4. Front of proposed new house and new paved driveway have been located to avoid sanitary sewer <br /> grinder pump with 15 feet diameter easement and force main and sewer lateral with 8 foot wide <br /> easement. <br /> 5. Because of the Board of Adjustment's action on Appeal 3437, reversing the interpretation of the <br /> Dane County Zoning Administrator in regard to the buildability of substandard parcels in the <br /> Shoreland district, all applicants for development of substandard lots in the Shoreland district must <br /> first obtain variances for minimum lot width and area. <br /> 6. The agent described how drainage would be provided using shallow swales on both side of the <br /> house, and stated that there would be no objection to using a rain garden on the lake side of the <br /> house to provide infiltration. <br /> Motion: Long/Klopp to abey the variance appeal until the July 26, 2007 Board meeting to allow the <br /> applicant to 1) meet with the Town of Dunn and provide information to nearby property owners; 2) <br /> provide for mitigation of runoff, including possible use of a rain garden or gardens, and 3) add detail to <br /> plan including lot coverage. <br /> Motion carried: 5 — 0. <br /> 3. Appeal 3480. Appeal by Anne L. Martino for variances from minimum lot width, minimum lot area <br /> and maximum lot coverage for a platted lot in the Shoreland district and for a variance from minimum <br /> required setback from Ordinary High Water Mark as provided by Sections 11.03(1), 10.05(4) and <br /> 11.03(2), Dane County Code of Ordinances, to permit deck addition to existing single-family residence <br /> at 2864 Lakeside Street being Lot 4, Block 1, Waubesa Beach, First Addition, Section 08, Town of <br /> Dunn. <br /> COMMUNICATIONS: <br /> 04/12/2007 Letter from Rosalind Gausman, Clerk, Town of Dunn, indicating Anne Martino contacted <br /> the Town regarding "a lot size variance needed to do a deck addition to an existing residence..." <br /> 05/07/2007 Nine (9) letters signed by neighbors indicating no objection to proposed deck addition, <br /> submitted by agent with Variance application. <br />
