COMPOSITE REPORT 8232 ITEM 915 <br />A -1EX to RH -2 <br />Gregory Du Bois & Kathie <br />Campbell, owners; <br />Birenkott Surveying, agent; <br />Cross Plains 16 <br />Background <br />Gregory DuBois and Kathie Campbell own (2) lots zoned A -IEX Non - Conforming <br />(legally created, `grandfathered' lots). Their home is located on a 1.98 net acre parcel, <br />and the remaining 13.253 acre parcel is vacant, described as "undeveloped woodland <br />with rocky outcroppings." <br />They now wish to reconfigure the existing parcels to create (2) RH -2 zoned lots: <br />• A 4.68 net acre parcel including the house, which "would continue to be their <br />homesite;" and <br />• A 10.54 net acre parcel, which "could be sold to be used as a homesite or for a new <br />driveway access that [meets] local code (to replace another driveway that does not <br />meet code for a neighbor.)" <br />Relevant Town Plan Policies <br />The subject property is a legal, non - conforming (substandard) A -1EX parcel located in <br />the Town's Agricultural Preservation District. The following policies apply: <br />"Substandard parcels of 4 — 35 acres, created prior to December 1981, are entitled to a <br />single division oj'2 or more acres, subject to the following conditions: <br />(1) No substandard parcel which previously has been divided may be divided <br />again. <br />(2) The remainder of the divided parcel must not be less than 2 acres. <br />(3) All state, county or town ordinances, statutes and other requirements dealing <br />with divided parcels must be met. " <br />Dane County Agency / Town Comments <br />The agencies and /or local government bodies listed below have submitted the following <br />comments regarding this petition. <br />Dane County Environmental Health <br />The existing private sewage system must remain on the same parcel with the <br />dwelling. (For more information about these comments, please contact Jim Clark <br />at 242- 6515.) <br />Dane County Planning and Development <br />The subject property was split off from a larger farm unit in June of 1981, prior to <br />Town plan adoption. According to Land Division Review Officer, Norb Scribner, <br />the lots created under Certified Survey Map 44057, 4077 (subject property) are <br />valid legal parcels of record (from correspondence to applicant dated March 20, <br />'1001).
