Setterholm in 1985 would have the potential for up to eight(8) <br /> additional homesites. However,the property is now owned by several landowners, including <br /> two, Kalscheur Investments and Scott Moe,who own at least 35 acres of the original farm. Your <br /> client should provide a recorded agreement, signed by affected landowners, detailing how the <br /> remaining potential homesites should be allocated. <br /> The Town of Vermont/Dane County Comprehensive Plan includes the following policy <br /> specifically for these situations: <br /> "In situations where there has been no formal recording of the allocation of`potential <br /> development rights"when land has been divided, it is up to the past and current owners <br /> of the land to reach agreement in writing before bringing a proposal before the Town <br /> Board. In the absence of a written agreement, the Town Board and Plan Commission will <br /> allocate "potential development rights"in proportion to the number of acres in each <br /> parcel. In no case shall the total number of potential development rights exceed that <br /> determined based on the January 1, 1985 acreage as described above" <br /> I hope this information is helpful.
