b. Voting. Unit 2, Unit 8, Unit 9 and Unit 10 shall each have one vote in the <br /> Association as set forth in Section 5.3 of the Declaration. <br /> 3. Ownership, Maintenance and Repair of Units 2, 8, 9 and 10. The <br /> following provisions only apply to Units 2, 8, 9, 10. <br /> a. Ownership, Maintenance and Repair of Building 2. The Unit Owners of <br /> Units 2, 8, 9, and 10 shall each own the portion of the building("Building <br /> 2")that is located within their Units. The Unit Owners of Units 2, 8, 9, <br /> and 10 shall, at their own cost and expense, be responsible for the <br /> maintenance and repair of the portion of Building 2 that is located within <br /> their Unit including,without limitation,the exterior surface of Building 2, <br /> landscaping,the driveway,painting of the same as often as necessary,the <br /> replacement of trim and caulking, and the maintenance and repair of the <br /> roof and exterior siding. For any Proposed Work that is done jointly by the <br /> Unit Owners(for example, structural items,repair of the exterior of the <br /> Building,the roof, etc.),the Unit Owners shall be responsible for their <br /> portion of the cost of the Proposed Work in the following percentages: <br /> UNIT PERCENTAGES <br /> 2 33% <br /> 8 11% <br /> 9 11% <br /> 10 45% <br /> b. Duty to Maintain and Repair Building 2. The Unit Owners of Units 2, 8, 9, <br /> and 10 agree to jointly maintain the structural components and exterior of <br /> Building 2, any portion of the electrical systems, plumbing,or other <br /> mechanicals that serve more than one Unit, the driveway and parking lot, <br /> and the landscaping. If any Unit Owner of Units 2, 8,9, and 10 considers <br /> any structural component,the exterior of Building 2, any portion of the <br /> electrical systems, plumbing,or other mechanicals that serve more than <br /> one Unit,the driveway or parking lot, or the landscaping, in need of repair <br /> or maintenance (the "Proposed Work"), the Unit Owner shall give written <br /> notice to the other Unit Owners. Such notice shall specify the nature, <br /> extent and estimated cost of the Proposed Work. If a Unit Owner refuses <br /> to agree to have the Proposed Work performed or disagrees, in writing, <br /> that such Proposed Work is needed,then, the Unit Owner that proposed <br /> the work may: (i)agree to not have the Proposed Work done; or(ii)within <br /> thirty (30) days from the receipt of said written notice, submit the issue of <br /> the necessity, nature and extent, and estimated cost of the Proposed Work <br /> to binding arbitration pursuant to Wis.
