IF Iv', Dane County Planning & Development <br /> 1, Division of Zoning <br /> r4kSCpN4's <br /> Joe Parisi <br /> Dane County Executive <br /> February 26, 2021 <br /> Scott&Elizabeth Herrling <br /> 3987 Barlow Rd <br /> Cross Plains WI 53528 <br /> RE:Navigability Determination—4518 State Highway 78, Section 11, Town of Vermont <br /> Parcel: 0706-111-8970-1, 0706-111-8001-3, and others <br /> The Dane County Zoning Division has processed your request for a navigability determination <br /> for a stream that is located on your property at 4518 State Highway 78. <br /> Before conducting the site inspection, the County G.I.S., aerial photography, and the Wisconsin <br /> Surface Water Data Viewer were used to determine the categorization of this waterway. The map <br /> shows that there is an intermittent stream located on the property. An intermittent stream is one <br /> that has a periodic or recurrent flow. <br /> A site inspection was conducted on February 26,2021. It was observed that stormwater flow was <br /> diffuse over land with no channelization and no definite bed or bank until reaching the ditch of <br /> State Highway 78. Wetland flora was also observed in the north western portion of the property. <br /> After further review of the intermittent stream, it has been determined that it is NOT navigable <br /> until downstream of the culvert under State Highway 78. <br /> This letter serves as notice that any development that will occur on the portion of your property <br /> that is within 300 feet of the downstream outlet to the State Highway 78 Culvert is within the <br /> Shoreland Zoning District as defined under Chapter 11, Dane County Code of Ordinances and <br /> therefore subject to shoreland regulations. Lands beyond 300 feet from this point are not within <br /> the shoreland zoning district. <br /> Before any development within 75 feet of the observed wetland area can be permitted, a wetland <br /> delineation will be required. <br /> For development outside of the shoreland zoning district, and beyond 75 feet from the observed <br /> wetland, shoreland zoning regulations do not apply. <br /> I hope you find this information helpful.
