If delivery of <br /> your building material is delayed through no fault of MBI, upon notice the order may be re-priced by MBI, atter <br /> which point you can elect to accept the revised pricing or terminate the Agreement. . If the order is terminated <br /> expenses accrued plus reasonable overhead and profit will be due.The responsibilities for site preparation, <br /> foundation or permitting which are yours must be completed before materials are delivered to the job site. If the <br /> site is not prepared upon arrival of materials, Morton has the option of delivering the materials or returning the <br /> materials to the origin of shipment. If materials are delivered, you will be responsible for any damage to materials <br /> due to storage at the site or other causes outside Morton's control. Morton may stop work if any payment, including payment for <br /> authorized extra work, is not made to Morton according to the terms of this Order. If such non-payment occurs, <br /> Morton may keep the job idle without liability until all payments are received.As a condition to entitlement to <br /> payment, Morton must furnish Owner conditional lien waivers from itself and any subcontractors engaged to <br /> perform the work. <br /> Page 3 item number 2 Is changed to: In the event of default by Owner under any term of this Order, <br /> including the schedule set forth in the Payment Terms, Morton shall be entitled to 1 1/2% per month interest(18% <br /> annual rate) or the maximum rate allowed by law in the state where the Work is located if less than 18% annual <br /> rate. <br /> Page 3 item number 4 is changed to: Title to all materials incorporated in the project shall remain with <br /> Morton until Owner has made all payments therefor.
