-z- lvol 41$ =294 <br />THIRD: No lot or any building thereon shall be sold <br />or leased to any negro, negroes or Italian; <br />FOURTH: No business place shall be erected except on <br />Lots One (1), Two (2), Three (3), Four (4), Five (5) and Six (6) <br />in Block One (1); <br />5. WHEREAS, the restrictions provide manner to be <br />followed in the release of such restrictions all set forth in the deeds <br />herein referred to and such provision is as follows: <br />"All the restrictions as above set forth shall continue <br />until July 1, 1946, and shall continue automatically thereafter until <br />the owners of the majority of the set acreage of Elmhurst shall at <br />any time after said date execute and acknowledge an agreement <br />or agreements in writing, releasing Elmhurst or any part thereof <br />from any or all of the above restrictions, and file the same for record <br />in the Office of the Register of Deeds for line County, Wisconsin. <br />The termination of any of the above restrictions in the manner provided <br />shall in no wise alter restrictions not so terminated. <br />It is hereby made an express condition hereof that any owner <br />of land in Elmhurst or any resident of Elmhurst shall be a proper person <br />to do or cause to be done, anything necessary and proper to enforce <br />any or all of the above restrictions. " <br />6. WHEREAS, it appears that a commercial use of that <br />parcel owned by parties of the first part would not impair or adversely <br />effect the use of the premises of other owners of lots located within the <br />plat of Elmhurst in the Village of Monona, and the parties hereto being <br />in agreement that the restrictions set forth in the conveyances of the lots <br />in Elmhurst should be eliminated and such restrictions declared void and <br />of no effect; <br />NOW THEREFORE, in consideration of the mutual covenants <br />of the parties hereto and for One Dollar ($1.00) and other good and valuable <br />consideration, receipt whereof is hereby acknowledged; <br />1. It is agreed by and between the parties hereto that the <br />restrictions hereinbefore set forth in full shall be and they hereby are <br />released from all further effect as to that parcel of real estate owned by <br />first parties and described as: <br />Lot Seven (7), Block One (1), and the East three feet <br />(E T) of Lot Eight (8), Block One (1), Elmhurst, in <br />the Village of Monona, Dane County, Wisconsin; <br />and it is further agreed between the parties that a copy of this agreement <br />
