717231. <br />AGREEMENT AS TO RESTRICTIONS <br />KNOW ALL MEN BY THESE PRESENTS THAT: <br />VOL VJ plag 7 <br />WHEREAS, Erna Sophia Vogel is the owner in fee simple of the <br />following described premises, to -wit: <br />A parcel of land lying in and being a part of the <br />Southeast 1/4 of the Northeast 1/4 of Section 11, <br />Town 7 North, Range 8 East and within the corporate <br />limits of the Village of Middleton, County of Dane, <br />State of Wisconsin and more fully described as <br />follows: Beginning at the Southeast corner of the <br />Southeast 1/4 of the Northeast 1/4; thence North 89° <br />491 West 479.75 feet; thence North 3° 201 East 153 <br />feet; Bence North 89° 491 West 100 feet; thence <br />South 3 201 West 153 feet; thence North 89° 491 <br />West 706.1 feet to the East line of Bristol Street; <br />thence North 3° 201 East 514.45 feet; thence North <br />89° 491 West 33.05 feet; thence North 3° 201 East <br />137.75 feet; thence South 89° 491 East 1320.70 feet; <br />thence South 3° 301 West 652.20 feet to beginning, <br />except the following described parcel: Beginning <br />North 3° 301 East 33.05 feet and North 890 491 West <br />33.05 feet from said Southeast corner; thence North <br />3° 301 East 120 feet; thence North 890 491 West <br />100 feet; thence South 3° 301 West 120 feet; thence <br />South 89° 491 East 100 feet to beginning; <br />AND WHEREAS, Erna Sophia Vogel has caused the above described <br />premises to be platted into lots and blocks now known as Park Lawn, <br />being a part of the Southeast 1/4 of the Northeast 1/4 of 6ection 11, <br />Town 7 North, Range 8 East, within the cor, -orate limits of the Villa „e <br />of Middleton, Dane County, Wisconsin, recorded December, 1CJ45, <br />in Vol. 1l of Plats, Parfe 1a, in the office of the Register cf <br />Deeds for Dane County, Wisconsin, including the following nubered <br />lots in the following numbered blocks, to -wit: <br />Lots 1 -16, both inclusive, Block 1, <br />Lots 1-17, both inclusive, Block 2, <br />Lots 1- 8, both inclusive, Block 3, <br />Lots 1- 7, both inclusive, Block 4; <br />NOW THEREFORE, said Erna Sophia Vogel hereby declares that <br />all of the lots in the said plat of Park Lawn hereinbefore described <br />be and the same hereby are subject to the following: <br />Protective Covenants <br />These covenants are to run with the land and shall be binding <br />on all parties and all persons claiming under them until January 1, 1:67, <br />at which time said covenants shall be automatically extended for <br />successive periods of 10 years unless by vote of a majority of the then <br />owners of the lots it is agreed to change said covenants in whole or in <br />part. <br />If the parties hereto, or any of them, or their heirs or assigns <br />shall violate or attempt to violate any of the covenants herein it shall <br />be lawful for any other person or persons owning any real property <br />situated in said development or subdivision to prosecute any proceedings <br />likat law or in equity against the person or persons violating or attempt- <br />ing to violate any such covenant and either to prevent him or them from <br />o doing or to recover damages or other dues for such violation. <br />
