Webber, his wife, as joint tenants, ,part es of the second part <br />Mitnesset1i, That the said party of the first part, for and in consideration of the sum of One Dollar ($1.005 and other valuable <br />consideration to it paid by the said part ie$ of the second part, the receipt whereof is hereby confessed and acknowledged, <br />has given, granted, bargained, sold, remised, released, aliened, conveyed and confirmed, and by these presents does give, grant, <br />bargain, sell, remise, release, alien, convey and confirm unto the said part ie5 of the second part, <br />/their <br />I' heirs and <br />assigns forever, the following described real estate, situated in the County of Dane and State of Wisconsin, to wit: <br />Starting at a concrete monument marking the intersection of <br />the northeasterly line of Balden Street and the southeasterly line of <br />Covall Street, as shown on the recorded plat for Forest Park, thence <br />southerly 100' on the easterly" line of Balden Street to an iron pipe <br />driven into the ground, which is the beginning of this description, <br />thence north 49° 21' east a 199,7 fta to a point marked by an iron <br />pipe driven into the ground, thence on a line whose bearing is south <br />300 36' east - 313 ft. to a point marked by a concrete monument set <br />in the ground, thence on a line whose bearing is south 18° 25' east - <br />141 ft, to a concrete monument set in the ground, thence on a line <br />whose bearing is south 25° 45' west - 14802 fte to a concrete monu- <br />ment set in the ground on the easterly side of Balden Street, thence <br />northwesterly along the easterly side of Balden Street approximately <br />500 ft. to the point of beginning0 The area described is approxi- <br />mately 1,67 acres, All bearings given in this description are referred <br />to the bearings on the recorded plat of Forest Parke <br />It is the intent to transfer all of the land between Balden <br />Street, Covall Street and the 5074 acre tract transferred to the Uni- <br />versity of Wisconsin in November. 1936, except the portion on Balden and <br />Covall Streets, as indicated on the accompanying plat, which has been <br />transferred to Merton Le Webber, Jr0 The lands herein transferred <br />are located in the Town of Madison, Dane County,'1Visconsin <br />-e >rgethrr with all and singular the hereditamcnts and appurtenances thereunto belonging or in any wise appertaining; and <br />all the estate, right, title, interest, claim or demand whatsoever, of the said party of the first part, either in law or equity, either <br />in possession or expectancy of, in and to the above bargained premises, and their hereditaments and appurtenances. <br />!g° n halm sub to hsltt the said premises as above described with the hereditaments and appurtenances unto the said <br />part i es of the second part, and to their heirs and assigns FOREVER. <br />PROVIDED, Ii0\VEVER, that this deed of conveyance shall be subject to the reservation restrictions herein stated, which are <br />intended for the mutual benefit and advantage of all lots in said plat, and which shall run with the land, to wit: <br />1. No intoxicating liquors shall ever be manufactured or sold on any lot in said plat. <br />2. No building or any part thereof, nor addition thereto shall ever be erected or maintained upon any lot in said plat between <br />the street line or street lines contiguous to the same, and the lines designated in said plat as building lines. <br />No building nor ahy part thereof, nor any addition thereto shall ever be erected or maintained upon any corner lot in said <br />plat between the rear building line of said corner lot, as designated in said plat, and the side line of the adjoining lot. <br />3. None of said lots shall be conveyed to, used, owne >g2rboccupied by Negroes as owners or tenants. <br />4. For a period of twenty -five years from January 1,Xklit first party shall have the right to require plans showing the ex- <br />ternal design of any building or structure to be erected upon any lot in said plat, to be first submitted to and approven by an <br />expert, acceptable to first party. <br />5. That for said period of twenty -five years no building on any lot in said plat shall be used for other than residence purposes <br />without written consent of the first party. <br />6. That for said period of twenty -five years no building erected elsewhere shall be moved upon any lot in said plat. <br />7. That for said period of twenty -five years no building, designated to be occupied by more than one family shall be built <br />more than two stories high on any lot in said plat without the written consent of the first party. <br />8. That for said period of twenty -five years no more than one dwelling house shall be constructed on any lot in said plat <br />without the written consent of the first party. <br />9: There is hereby reserved to first party and its successors the rigltt to use that part of said plat designated thereon as "Pub- <br />lic Service Strip" for the purpose of installing, repairing, renewing, extending, and maintaining thereon poles, wires, pipes, con- <br />duits, and other constructions and accessories for sewer, water, gas, light, heat, power, telegraph, telephone, and other public <br />service purposes, and the right is further reserved to first party to permit the use of said "Public Service Strip" for any public <br />purpose by any public service corporation which it shall designate. <br />Anr flit saih LAKE FOREST COMPANY, party of the first part, for itself and its successors,--does covenent, grant, bargain, and <br />agree to and with the said parties of the second part, their heirs and assigns, that at the time of the ensealing and <br />delivery of these presents it is well seized of the premises above described, as of a good, sure, perfect, absolute and indefeasible <br />estate of inheritance in the law, in fee simple, and that the same are free and clear from all incumbrances whatever. <br />and that the above bargained premises in the quiet and peaceable possession of the said parties of the second part, their <br />heirs and assigns, against all and every person or persons lawfully claiming the whole or any part thereof, it will forever WAR - <br />RANT and DEFEND. <br />11 rr, lilies, all hgreuc, the said LAKE FOREST <br />by C.
