<br />husband and wife, as joint tenants, pastiest of the second part,
<br />ftneCath, That the said parties of the first part, for and in consideration of the sure of
<br />. One (1) Dollar and other valuable considerations - 'R'x
<br />to them in hand paid by the said parties of the second part, the receipt whereof is hereby con-
<br />fessed and acknowledged, ha vet given, granted. bargained, sold, remised, released, aliened, conveyed
<br />and confirmed, and by these presents do. give, grant, bargain, sell, remise, release, alien, convey and
<br />confirm unto the said parties of the second part, as joint tenants, the following described real estate situ-
<br />ated in the County of Dane , Wisconsin, to -wit:
<br />Lot Twelve (12), Plat of Heim s Woods, town of Middleton, Dane County,
<br />Wisconsin, subject to the following restrictions*
<br />1. Only members of the Caucasian race shall use or occupy any
<br />dwelling on said lot, except that this covenant shall not prevent
<br />occupancy by domestic servants of a different race or nationality
<br />employed by an owner or tenant.
<br />2. Said lot shall be used strictly for residential purposes,
<br />and no building shall be erected thereon except one attached single —
<br />family dwelling and a one or two car garage. No garage erected on said
<br />lot shall be used as a residence temporarily or permanently. No build- -
<br />ing previously erected elsewhere shall be moved upon said lot.
<br />3. No noxious or offensive trade shall' be carried on upon said
<br />lot nor shah. anything be done thereon which maybe or become an annoy
<br />ante or nuisance to the neighborhood.. This shall not be construed to
<br />prevent a family garden or' orchard.
<br />4. No building shall be erected on said lot until the location
<br />and design thereof shall have been approved in writing by an expert
<br />appointed by Ferdinand J. Heim, his executors, administrators or
<br />heirs.
<br />5. The restrictions herein set forth are provided for the
<br />benefit of all parties owning an interest in said Heimts Woods Plat
<br />and may be enforced by any person, firm or corporation having such
<br />an interest therein. These restrictions shall be binding for a
<br />period of twenty —five years from June 1,- 1937,
<br />gogetbtt, with all and singular the hereditaments and appurtenances thereunto belonging or in anywise
<br />appertaining; and all the Eestate, right, title, interest, claim or demand whatsoever, of the said part leg
<br />of the first part, either in law or equity, either in possession. or expectancy of, in and to the above bargain-
<br />ed premises, and their hereditaments and appurtenances. .
