ORD. AMDT. 17, 1992-93 EFFECTIVE: 11/11/92 <br /> AMENDING CHAPTER 10 OF THE DANE COUNTY CODE OF ORDINANCES. <br /> RELATING TO THE EXCLUSIVE AGRICULTURAL DISTRICT <br /> The County Board of Supervisors of the County of Dane does ordain as follows: <br /> ARTICLE 1. Unless otherwise expressly stated herein, all references to section and <br /> chapter numbers are to those of the Dane County Code of Ordinances. <br /> ARTICLE 2. Section 10.01 (Intro.) is amended to read as follows: <br /> • <br /> (Intro.) For the purposes of this chapter certain terms used <br /> herein are defined as set forth in this section. <br /> Words and phrases not defined in this section or <br /> elsewhere in the ordinance shall be construed by <br /> resort to the following, in order of preference: <br /> Wisconsin Statutes; Wisconsin zoning case law; other <br /> states' zoning case law; the dictionary; and common <br /> usage. <br /> ARTICLE 3. Subsection (23a) of section 10.01 is renumbered as subsection (23h) <br /> thereof. <br /> ARTICLE 4. Subsections (23f), (23g), (23m) and (36g) of section 10.01 are created <br /> to read as follows: <br /> (23f) Farm means a tract of land utilized for the purpose of <br /> agricultural production, a tract of land devoted to <br /> the raising and breeding of domestic livestock, an <br /> area of water devoted to the raising and breeding of <br /> aquatic animals. <br /> (23g) Farm accessory building means an accessory building or <br /> buildings which are used in the operation of a farm. <br /> (23m) Gross income means Wisconsin adjusted gross income as <br /> defined in sec. 71.01(13), Wis. •Stats. 1989-90. <br /> (36g) Majority means more than one half of the pertinent <br /> total. <br /> ARTICLE 5. Section 10.123(2)(b) is amended to read as follows: (b) Residence for a <br /> property owner of at least 35 contiguous acres subject to the following: • - <br /> 1. The residence and any accessory buildings may not be located on land devoted <br /> primarily to agricultural use. (As determined by the Zoning & Natural <br /> Resources committee). <br /> 2. The residential use shall not limit the surrounding lands potential for <br /> agricultural use. (As determined by the Zoning & Natural Resources committee). <br /> 3. The residential use shall not conflict with agricultural use on the land or on <br /> other properties. (As determined by the Zoning & Natural Resources committee). <br />
