;�- Cry --- - � -- y <br /> ORD.AMEND. 9, 1993-94 <br /> AMENDING CHAPTER 10 OF THE DANE COUNTY CODE OF ORDINANCES, RELATING TO <br /> DEFINITIONS,AGRICULTURAL AND AGRICULTURE BUSINESS DISTRICTS, STANDARDS FOR MINERAL <br /> EXTRACTION AND LIMITED FAMILY BUSINESSES, NONCONFORMING USE <br /> ARTICLE 1: All references herein to sections are to those of the Dane County Code of Ordinances unless <br /> otherwise expressly stated. <br /> ARTICLE 2: Section 10.01(3) is amended to read as follows: <br /> (3) "Animal Unit". One animal unit shall be defined as being the equivalent of 1 cow, 4 hogs, 10 <br /> sheep, 10 goats, 100 poultry, 1 horse, 1 pony, 1 mule or 100 rabbits or an equivalent combination thereof. <br /> [EXPLANATION: This amendment changes the definition of'animal unit'as shown.] <br /> ARTICLE 3: Section 10.01(5m) is created to read as follows: <br /> (5m) "Bee Keeping". Keeping of more than 1 hive for each 10,000 square feet of lot or parcel area. <br /> [EXPLANATION: This amendment creates a definition for 'bee keeping' and has the effect of allowing <br /> beekeeping when the density of hives is 1 or less for each 10,000 square feet.] <br /> ARTICLE 4: Section 10.01(30a) is amended-to read as follows: <br /> (30a) "Livestock". Livestock shall include but is not limited to cows, sheep, goats, hogs, draft horses, <br /> pleasure horses and ponies, mules and poultry. For purposes of this ordinance 100 or more rabbits shall be <br /> considered livestock and subject to the regulations pertaining to the keeping or livestock. <br /> [EXPLANATION: This amendment expands the definition of livestock to include the keeping of 100 rabbits.] <br /> ARTICLE 5: Section 10.01(36m) is created to read as follows: <br /> (36m) Mineral Extraction. Quarrying or excavation of sand, gravel, limestone, earth, soil or other <br /> mineral resources. This definition includes (when done in connection with mineral extraction) accessory uses <br /> such as washing, crushing and other processing of the materials, the erection of structures and the installation <br /> or storage, or both, of the necessary machinery and equipment used in the mineral extraction operation. <br /> Production of asphalt or concrete is not to be considered part of a mineral extraction operation. <br /> (a) The following uses are not part of a mineral extraction operation: site preparation for residential <br /> or commercial plats, construction or landscaping projects, soil conservation practices, stream, lake or <br /> shoreline protection, agricultural land leveling projects if materials are not removed from the property and <br /> similar uses. <br /> [EXPLANATION: This amendment creates a definition for the phrase 'mineral extraction.] <br /> ARTICLE 6: Section 10.01(41) is amended to read as follows: <br /> (41) "Non-conforming Use". A lawful use that existed prior to adoption of an ordinance which <br /> restricted or prohibits said use. [See section 10.21] <br /> [EXPLANATION: This amendment changes the definition of 'nonconforming use,' as shown.] <br /> ARTICLE 7: Section 10.01(49m) is created to read as follows: <br /> (49m) Seed Business. A business that sells seed on a retail or wholesale basis. A farm operation that <br /> includes sale of seed to other farmers on an occasional basis is not considered to be a seed business unless a: <br /> salesperson or salespersons is or are employed; sales of other products such as fertilizer or pesticides are <br /> made; the operation includes wholesale distribution to other dealers; or new buildings are constructed or <br /> existing buildings are improved to accommodate the sales of seed. <br /> [EXPLANATION: This amendment creates a definition for the term 'seed business,' as shown.] <br /> ORD010z - 1 <br /> • <br />
