ARTICLE 53: Section 10.21(1) is amended to read as follows: <br /> Section 10.21 NONCONFORMING USES. (1) (a) The lawful use of a building or premises existing at the <br /> time of adoption of this ordinance may be continued as a nonconforming use, but if such nonconforming use, <br /> shall be discontinued for a period of one (1) year, such nonconforming use will be deemed to have <br /> terminated and any future use shall be in conformity to the provisions of this ordinance except as otherwise <br /> provided by this ordinance. <br /> (b) No building or premises used as a nonconforming use shall be added to or structurally altered so as to <br /> increase the facilities for such nonconforming use. <br /> (c) Mineral extraction operations which existed prior to 1969 and were registered with an approved by <br /> the Dane County Zoning Administrator shall be considered nonconforming uses. <br /> (d) Mineral extraction sites that were registered as nonconforming sites as provided by this ordinance <br /> shall not be considered abandoned or discontinued if the site is inactive for more than one year. <br /> [EXPLANATION: This amendment adds clarifying language with respect to mineral extraction operations.] <br /> ARTICLE 54: Existing sub-subsections (c) through (m) of section 10.255(2) are renumbered as sub-subsections <br /> (d) through (o), respectively, of said section and a new sub-subsection (c) thereof is created to read as follows: <br /> (c) The town board of the town wherein a conditional use is proposed to be located shall be given notice <br /> and opportunity to participate in the conditional use process. The town board may review the conditional <br /> use permit application and thereafter may make a finding of consistency or inconsistency with the town land <br /> use plan, if any, as well as suggested conditions for any permit which it may recommend granting. If its <br /> members so desire, the town board may transmit its findings and recommendations to the Committee. <br /> Findings and recommendations should be stated in terms of the standards set forth in sec. 10.255(2)(h), as <br /> well as relevant policies contained in the town land use plan. The recommendations and findings of the town <br /> will be advisory to the Committee. <br /> [EXPLANATION: This amendment codifies the existing practice whereby towns have input into conditional <br /> use permits.] <br /> ORD010z - 10 <br />
