[EXPLANATION: This amendment creates additional conditional uses in the A-1 Agriculture District.] <br /> ARTICLE 14: Subsection (4), as renumbered, of section 10.12 is amended to read as follows: <br /> (4) Building height limits. <br /> 1. Residential dwellings shall not exceed 2 1/2 stories or 35 feet in height. <br /> 2. Residential accessory buildings shall not exceed 16 feet in height. <br /> 3. Agricultural accessory buildings are not restricted as to height. <br /> [EXPLANATION: This amendment establishes clearer standards for residential and agricultural buildings in <br /> this district.] <br /> ARTICLE 15: Subsection (6), as renumbered, of section 10.12 is amended to read as follows: <br /> (6) Setback requirements. No building, including barns and other farm buildings of any description <br /> whatsoever, shall be erected, moved or structurally altered so as to be nearer a highway than is prescribed by <br /> Section 10.17. <br /> [EXPLANATION: This amendment makes only grammatical changes.] <br /> ARTICLE 16: Renumbered subsection (7) of section 10.12 is amended to read as follows: <br /> (7) Side yard requirements. (a) Side yards for residential dwellings and residential accessory <br /> buildings shall be the same as for the R-1 Residence District. <br /> (b) Accessory buildings, cages, kennels, hives and runs for housing of animals or insects shall be <br /> located at least 100 feet from a R-1, R-2, R-3, R-3A or R-4 Residence District. <br /> [EXPLANATION: This amendment clarifies the distance that certain agricultural buildings are required to be <br /> located from residential district buildings.] <br /> ARTICLE 17: Renumbered subsection (8) of section 10.12 is amended to read as follows: <br /> (8) Rear yard requirements. (a) Rear yards for residential dwellings and residential accessory <br /> buildings shall be the same as for the R-1 Residence District. <br /> (b) Accessory buildings, cages, hives, kennels and runs for housing of animals or insects shall be <br /> located at least 100 feet from a R-1, R-2, R-3, R-3A or R-4 Residence District. <br /> [EXPLANATION: This amendment clarifies what is intended for rear yard requirements in this district.] <br /> ARTICLE 18: Existing subsection (1) of section 10.121 is renumbered as subsection (2) thereof and existing <br /> subsections (2) through (8) of section 10.121 are renumbered, respectively, as subsections (4) through (10) <br /> thereof. <br /> [EXPLANATION: This amendment is to accommodate two new subsections set forth below. No substantive <br /> change is intended.] <br /> ARTICLE 19: Subsections (1) and (3) of section 10.121 are created to read as follows: <br /> (1) The A-B Agriculture-Business District is designed to provide for those uses which are commercial <br /> in nature; are associated with local agricultural production; require a rural location due to extensive land area <br /> needs or proximity of resources; and do not require urban services. <br /> (3) Conditional uses. (a) Plant genetic laboratories, agricultural related experimental laboratories; <br /> (b) Dead stock hauling services; <br /> (c) Sales or storage of agricultural by-products; <br /> (d) Stock yards, livestock auction facilities. <br /> [EXPLANATION: Sub. (1) is intended to create a statement of purpose for the A-B Agricultural-Business <br /> District. Sub. (3) creates conditional uses, some of which were permitted uses.] <br /> ORD010z - 3 <br />
