(6) The conditional use permit may restrict the number and types <br /> of machinery and equipment the permit holder may be allowed to <br /> bring on the premises . <br /> (7) Structures used in the business shall be considered to be <br /> residential accessory buildings and shall meet all requirements <br /> for such buildings. The design and size of the structures is <br /> subject to conditions set forth in the conditional use permit. <br /> ( 8) The conditional use permit shall automatically expire on <br /> sale of the property or the business to an unrelated third party. <br /> [EXPLANATION: The first amendment recodifies the existing <br /> requirements for mineral extraction operations and locates those <br /> requirements in one section of the ordinance. The second <br /> amendment creates a new conditional use and in ' doing so its <br /> intent is to allow for these uses without creating the need for <br /> rezoning which then outlasts the purpose of the rezoning. ] <br /> ARTICLE 53: Section 10 . 21(1) is amended to read as follows <br /> Section 10.21 NONCONFORMING USES. (1) (a) The lawful use of a <br /> building or premises existing at the time of adoption of this <br /> ordinance may be continued as a nonconforming use, but if such <br /> nonconforming use, shall be discontinued for a period of one (1) <br /> year , such nonconforming use will be deemed to have terminated <br /> and any future use shall be in conformity to the provisions of <br /> this ordinance except as otherwise provided by this ordinance. <br /> (b) No building or premises used as a nonconforming use shall be <br /> added to or structurally altered so as to increase the facilities <br /> for such nonconforming use. <br /> (c) Mineral extraction operations which existed prior to 1969 <br /> and were registered with and approved by the Dane County Zoning <br /> Administrator shall be considered nonconforming uses. <br /> (d) Mineral extraction sites that were registered as <br /> nonconforming sites 04 X %00E1'0pf X0/X701711a5 as provided by <br /> this ordinance shall not be considered abandoned or discontinued <br /> if the site is inactive for more than one year . <br /> [EXPLANATION: This amendment adds clarifying language with <br /> respect to mineral extraction operations. ] <br /> [ Article 54 on next page ] <br /> Page 19 of 20 <br /> 3110 : 040488 <br />
