I <br /> 11.02 ' Dane County Code 2a-46 <br /> CHAPTER 11 Section 11.02 Shoreland District <br /> Shoreland And Shoreland-Wetland (1) Authority: This shoreland <br /> Regulations section is adopted protection <br /> eg p pursuant to the author- <br /> ization found in Section 59.07 (51), 59.97, <br /> Section 11.01 Dane County Shoreland, 59.971, 87.30 and 144.26, Wis. Stats. <br /> Shoreland-Wetland and Flood <br /> Plain Management (2) Legislative finding: The County Board <br /> Section 11.02 Shoreland District does find that the uncontrolled use of the <br /> Section 11.03 Shoreland Regulations shorelands and pollution of the navigable <br /> Section 11.04 Shore Cover waters of Dane County adversely affect the <br /> Section 11.05 Filling, Grading, Lagooning, public health, safety, convenience, and general <br /> Dredging and Excavating welfare and impair the tax base. The legislature <br /> Ditching of Wisconsin had delegated responsibility to <br /> Section 11.06 Shoreland-Wetland District • the counties to further the maintenance of <br /> Section 11.07 Permitted Uses in the Shore- safe and healthful conditions; prevent and <br /> land-Wetland District control water pollution; protect spawning <br /> Section 11.08 Uses which are Allowed in grounds, fish and aquatic life; control building <br /> the Shoreland-Wetland Dis- sites, placement of structures and land uses; <br /> trict Subject to the Issuance and preserve shore cover and natural beauty, <br /> of a Zoning(Land Use) and this responsibility is hereby recognized by <br /> Permit Dane County. <br /> Section 11.09 Prohibited Uses <br /> Section 11.10 Re-Zoning of Lands in the (3) Statement of purpose: For the purpose <br /> Shoreland-Wetland Zoning of promoting and protecting the public health, <br /> 1 District safety, convenience and general welfare to: <br /> prevent and control water pollution; protect <br /> Flood Plain Regulations fish spawning grounds, fish and aquatic life, <br /> I control builing sites, placement of structures, <br /> preserve shore cover and natural beauty. <br /> Section 11.11 Statutory Authorization, <br /> Finding of Fact, Statement (4) Compliance: Unless specifically exempted <br /> of Purpose and Title by law, all cities, villages, towns and counties <br /> Section 11.12 General Provisions are required to comply with this Ordinance and <br /> Section 11.13 Regional Floodway District obtain all necessary permits. State agencies are <br /> (FW) required to comply when Section 13.48(13), <br /> Section 11.14 Regional Flood Fringe Dis- Wisconsin Statutes, applies. The construction, <br /> trict(FF) reconstruction, maintenance and repair of <br /> Section 1.1.15 . General Flood Plain District state highways and bridges by the Wisconsin <br /> (GFP) Department of Transportation are exempt <br /> Section 11.16 Non-Conforming Uses when Section 30..12(4)(a), Wisconsin Statutes, <br /> Section 11.17 Administration applies. <br /> Section 11.18 Amendments <br /> Section 11.19 Enforcement and Penalties (5) County Jurisdiction: <br /> Section 11.20 Definitions <br /> (a) Shoreland areas shall include all lands <br /> Section 11.01.Dane County Shoreland, Shore- in the unincorporated areas of Dane County <br /> land-Wetland and Flood Plain Management which are within 1,000 feee�tfrom the ordinary <br /> • high water mark e� anfviigable—laakes, ponds.or <br /> Note: This section is not subject to approval flowages listed in the "Surface-Wr Resources <br /> or disapproval by any town board as provided of Dane County" published by the Wisconsin <br /> , by Section 59.971 (2)(a), Wig.
