SUB. 2 TO ORD. AMENDMENT 12, 1989-90 DEC 17 1989 <br /> AMENDING CHAPTER 10 OF THE DANE COUNTY CODE OF ORDINANCES, <br /> RELATING TO PRESERVATION OF HISTORIC SITES. <br /> The County Board of Supervisors of the County of Dane does ordain as • <br /> follows: <br /> ARTICLE 1. Unless otherwise expressly stated herein, all references to [—i <br /> section and chapter numbers are to those of the Dane County Code of Ordinances. <br /> ARTICLE 2. Subsections (llm) and (24m) of sec. 10.01 are created to read as <br /> • <br /> follows: <br /> ■ <br /> (llm) "Clear area means an area adjacent to and completely surrounding <br /> each and every physical_structure comprising part or all of an historic <br /> site. No building or structure of any kind, whether or not a permit <br /> therefor is required under this chapter, shall be erected in the clear <br /> area and no obstacle of any kind, whether attached to an allowed structure (_c <br /> or not, shall be placed in the airspace above the clear area, and no soil <br /> disturbance shall occur in the clear area. <br /> (24m) "Historic site' means any burial site designated as an historic <br /> • site by the. County Board of Supervisors. A burial site has the definition <br /> set forth in sec. 157.70(1) (b) , 1987 Wis. Stats. Any action of the County <br /> • Board designating an historic site shall constitute a zoning map change <br /> and shall be subject to town approval and the protest rights of landowners <br /> under sec. 59.97, Wis. Stats. No person shall enter any property to <br /> survey the land for historic sites without the written.permission of the L_i <br /> property owner. <br /> ARTICLE 3. Section 10.01(73) is amended to read as follows: <br /> (73) "Structure" has the meaning set forth in s. 11.21(1) (ff) . <br /> 1 j <br /> ARTICLE 4. Section 10.01(74m) is created to read as follows: <br /> (74m) "Substandard lot" means a lot the dimensions of which, although <br /> fully conforming when created, are now in whole or in part, less than <br /> existing requirements for the zoning district in which located. <br /> ARTICLE 5. Section 10.157 is created to read as follows: ,i <br /> 10.157 HD Historic Overlay District. (1) Statement of Purpose. The • <br /> purpose of the Historic Overlay District is to effect and accomplish the <br /> protection, enhancement and perpetuation of such sites which represent or —' <br /> reflect elements of the county' s cultural history, and to safeguard the <br /> county's historic and cultural heritage as embodied in such sites, <br /> expanding upon such protection as is afforded by chapter 157, 1987, Wis. !` 1 <br /> Stets. - . <br /> (2) Designation. Historic sites may be designated not more frequently <br /> than four times per calendar year by petitioning the county board in a <br /> single petition grouping within it any sites desired to be designated. <br /> No site may be designated which is not cataloged. d <br /> 1 . <br />
