SECTION 10.25 <br /> Zoning Committee may be made as providided in 10.25 (4) (i). <br /> (m) Abandoned conditional uses; Any use, for which a conditional use permit has <br /> been issued, upon its cessation or abandonment for a period Of one year, will be <br /> deemed to have been terminated and any future use shall be in conformity of this <br /> ordinance. <br /> (8) CERTIFICATE OF COMPLIANCE <br /> (a) No building or addition thereto, constructed after the effective date of this <br /> ordinance and no addition to a previously existing-building shall .be occupied, ex- <br /> cept accessory buildings used exclusively for farming or agricultural purposes and <br /> no land vacant except that used exclusively for farming or agricultural purposes on. <br /> the effective day of this ordinance shall be used for any purpose until a certifi- <br /> cate of compliance has been issued by the County Zoning Supervisor. Every. certifi- <br /> cate. of compliance shall state the use and occupancy and the location Of the building <br /> or buildings or use of land complies with all -of the provisions of this ordinance. <br /> (b). Every application for a building permit shall be considered to be an application <br /> for a certificate df compliance. <br /> (c) An :application for a certificate of compliance for a new use or a change in use <br /> of land or a building shall be made directly tb. the. Zoning Supervisor. <br /> (d) No certificate of compliance for a..building or addition thereto, constructed <br /> after the effective date of this ordinance shall be issued until construction has <br /> been substantially completed and the premises inspected and certified by the Zoning <br /> Supervisor to be in conformity with:the specifications on which the permit was issued. <br /> The Zoning Supervisor may establish rules by which a temporary certificate of compli- <br /> ance may be issued for a part of a building. <br /> (e) Any person, firm or corporation having a legal or equitable interest in a property <br /> which is non-conforming as to use or building location may, request a certificate of <br /> compliance.. Said applicant shall present :documentary proof that said use was a per <br /> mitted use at the time it originated or that the building has been erected prior to <br /> the adoption of this ordinance and was made non-conforming by the _adoption of .this <br /> ordinance or amendment thereto. After certifying that the use of building or land are <br /> in fact non-conforming the Zoning Supervisor shall issue a certificate of compliance <br /> stating the use in question or the location of buildings and the zoning of the <br /> property. <br /> (f) Fees . <br /> 1. For certificates of compliance issued under (b) or (d) above, or if the building. <br /> had been erected since the adoption of the zoning ordinance and -a permit issued by <br /> the Zoning .Supervisor to cover same, no additional fee shall be charged. <br /> _ 2, For certificates of compliance issued under (c) or (e) above, a fee of five <br /> dollars ($5.00) shall be charged.. <br /> (9) PENALTIES <br /> (a) Any person or persons, firm, company, or corporation, either 'owner or occupant <br /> of the premises, who violates,' disobeys, omits, neglects or refuses, to comply with Or <br /> resists the enforcement of any of the provisions of this ordinance shall be subject. <br /> to a forfeiture of not to exceed two hundred dollars ($200.00) and costs; arid ;on <br /> default of payment of such forfeiture by imprisonment in the county jail until such <br /> forfeiture and costs are paid but not to exceed thirty (30) days. Each day that a <br /> violation is permitted to exist shall constitute a separate offense. Compliance <br /> herewith shall also be enforced by. injunctional order at the suit of the county or <br /> occupant of real estate within the district affected by the regulations of this ordi- <br /> nance. It shall not be necessary to prosecute for forfeiture before resorting to <br /> injunctional. 'proceedings. <br /> 33: - <br />
