SECTION 10.25; 10.26 <br /> (1) Revocation of a conditional use permit: If the Zoning Committee then finds that the standards in sub- <br /> section 10.25 (4)(g) and the conditions stipulated therein are not being complied with, the committee after <br /> a public hearing as provided in 10.25 (4)(e)(f) may revoke the conditional use permit. Appeals from the <br /> action of the Zoning Committee may be made as provided in 10.25 (4)(i). <br /> (m) Abandoned conditional uses: Any use, for which a conditional use permit has been issued, upon its <br /> cessation or abandonment for a period of one year, will be deemed to have been terminated and any future use <br /> shall be in conformity of this ordinance. <br /> ,i (8) CERTIFICATE OF COMPLIANCE <br /> (a) No building or addition thereto, constructed after the effective date of this ordinance and no addition <br /> to a previously existing building shall be occupied, except accessory buildings used exclusively for farming <br /> or agricultural purposes and no land vacant except that used exclusively for farming or agricultural pur- <br /> poses on the effective day of this ordinance shall be used for any purpose until a certificate of compliance <br /> has been issued by the County Zoning Supervisor. Every certificate of compliance shall state the use and <br /> occupancy and the location of the building or buildings or use of land complies with all of the provisions <br /> of this ordinance. <br /> (b) Every application for a building permit shall be considered to be an application for a certificate of <br /> compliance. <br /> (c) An Application for a certificate of compliance for a new use or a change in use of land or a building <br /> shall be made directly to the Zoning Supervisor. <br /> (d) NO certificate of compliance for a building or addition thereto, constructed after the effective date <br /> of this ordinance shall be issued until construction has been substantially completed and the premises in- <br /> spected and certified by the Zoning Supervisor to be in conformity with the specifications on which the <br /> permit was issued. The Zoning Supervisor may establish rules by which a temporary certificate of compliance <br /> may be issued for a part of a building. <br /> (e) Any person, firm or corporation having a legal or equitable interest in a property which is non-conforming <br /> as to use or building location may request a certificate of compliance. Said applicant shall present docu- <br /> mentary proof that said use was a permitted use at the time it originated or thatthe building has been <br /> erected prior to the adoption of this ordinance and was made non-conforming by the adoption of this ordinance <br /> or amendment thereto. After certifying that the use of building or land are in fact non-conforming the <br /> Zoning Supervisor shall issue a certificate of compliance stating the use in question or the location of <br /> buildings and the zoning of the property. <br /> (f) Fees <br /> 1. For certificates of compliance issued under (b) or (d) above, Or if the building had been erected <br /> since the adoption of the zoning ordinance and a permit issued by the Zoning Supervisor to cover same, no <br /> additional fee shall be charged. <br /> 2. For certificates of compliance issued under (c) or (e) above, a fee of five dollars ($5.00) shall be <br /> charged. <br /> (9) PENALTIES <br /> (a) Any person or persons, firm, company or corporation either owner, occupant or other user of the premises, <br /> who violates, disobeys, omits, neglects or refuses to comply with or resists the enforcement of any of the <br /> provisions of this ordinance 'shall be subject to a forfeiture of not less than five dollars, nor more than two <br /> hundred dollars and costs. Each day that a violation is permitted to exist shall constitute a separate <br /> offense. Compliance herewith shall be enforced by injunctional order at the suit of the county or occupant <br /> of real estate within the district affected by the regulations of this ordinance. It shall not be necessary to <br /> prosecute for forfeiture before resorting to injunctional proceedings. <br /> (b) Any person who has the ability to pay any lorleiture entered against him under this ordinance but refuses <br /> to do so may be confined in the county jail until such forfeiture is paid, but in no event to exceed thirty <br /> (30) days. In determining whether an individual has the ability to pay a forfeiture, all items of income and <br /> all assets may be considered regardless of whether or not such income or assets are subject to garnishment, <br /> lien or attachment by creditors. <br /> '10.26 BOARD OF ADJUSTMENT <br /> • <br /> (1) PERSONNEL, TERM AND COMPENSATION <br /> -26- <br />
