(,a`) Conditions on rezonings: <br /> ��1:- The Zoning Committee may recommend and the County Board may adopt an ordinance <br /> effecting an amendment of the zoning district map containing the condition that <br /> the change in the map will take effect on such date occurring within ( ) months <br /> of the date of County Board approval of the amendment when the first on-site in- <br /> spection for building location is made and approved for the project sought to <br /> be established, and in the event such approved inspection has not occurred by the <br /> ( ) month time period, the possibility of making effective the re-zoning will then <br /> be terminated. <br /> 0'. The Zoning Committee may recommend and the County Board may adopt an ordinance <br /> effecting an amendment of the zoning district map containing the condition that <br /> the change in map will take effect on such date occurring within ( ) months of <br /> the date of County Board approval of the amendment when a restrictive covenant has <br /> been recorded binding the property to conditions specified in the amending ordinance, <br /> and in the event such covenant is not recorded by the end of the ( ) month time <br /> period, the possibility of making effective the re-zoning will then be terminated. <br /> Conditions specified to be in such required covenants shall be related to the pur- <br /> poses of the ordinance. They may include, as specific cases warrant, limits of <br /> permissable uses to less than the full range of uses otherwise allowable in the <br /> district into which the land is being placed. Enforcement rights over such cove- <br /> nant controls shall be a afforded to the County, the town and owners of property <br /> within 300 feet of the site. The covenant controls shall be amendable or repeal- <br /> able upon petition of the owner of the lands subject to the controls, and approval <br /> by the County Board after a hearing similar to a re-zoning hearing. A re-zoning <br /> of the lands to a different zoning district shall also act to repeal the covenant <br /> controls. Except as provided above, the covenants shall run with the land. <br /> V/Other similar controls appropriate to handling by covenant provisions may also <br /> be imposed. <br /> ];0:26 BOARD OF ADJUSTMENT <br /> 41) PERSONNEL, TERM AND COMPENSATION <br /> (a) The Board of Adjustment shall consist of five (5) members, appointed by the County <br /> Executive with the approval of the County Board, each serving for a term of three <br /> (3) years, the terms beginning July 1st and being staggered so that the terms of not <br /> more than two members shall expire in any year. Members shall reside in the unin- <br /> corporated areas of the County and no two members shall be from the same town. Com- <br /> pensation of members shall be the same as allowed County Board members for attendance <br /> at Committee meeting. <br /> .C2) RULES, MEETINGS AND MINUTES <br /> ;(a}* The County Board shall adopt rules for the conduct of the business of said <br /> Board of Adjustment, in accordance with the provisions of any ordinance or ordi- <br /> nances adopted pursuant to Section 59.97, 59.971 or 87.30. The Board of Adjust- <br /> ment may adopt futher rules as necessary to carry into effect the regulations of <br /> the County Board. Meetings of the board shall be held at the call of the chairman <br /> and at such other times as the board may determine. Such chairman, or in his ab- <br /> sence the acting chairman, may administer oaths and compel the attendance of wit- <br /> nesses. All meetings of the board shall be open to the public. The board shall <br /> keep minutes of its :proceedings, showing the vote of each member upon each question, <br /> or, if absent or failing to vote, indicating such fact, and shall keep records of <br /> its examinations and other official actions, all of which shall be immediately filed <br /> in the office of the board and shall be a public record. <br /> (i(31' APPEALS TO THE BOARD <br /> (,a Appeals to the Board of Adjustment may be taken by any person aggrieved or by <br /> any officer, department, board or bureau of the municipality affected by any <br /> decision of the Zoning Administrator or other administrative officer. Such appeal <br /> shall be taken within a reasonable time, as provided by the rules of the board, by <br /> filing with the officer from whom the appeal is taken and with the Board of Adjust- <br /> ment a notice of appeal specifying the grounds thereof. The officer from whom the <br /> appeal is taken shall forthwith transmit to the board all the papers constituting <br /> the record upon which the action appealed from was taken. <br /> (41 STAYS <br /> (a) An appeal shall stay all proceedings in furtherance of the action appealed from, <br /> unless the officer from whom the appeal is taken shall cerify to the Board of <br /> Adjustment after the notice of appeal shall have been filed with him that by reason <br /> - 48 - <br />
