DANE COUNTY ZONING ORDINANCE <br /> BEING CHAPTER 10 OF THE ORDINANCES OF DANE COUNTY <br /> An ordinance, to be known as Chapter 10, Dane County Zoning Ordinance as adopted by the Dane <br /> County Board of Supervisors on July 20, 1938 as amended and including a comprehensive revision <br /> adopted by the Dane County Board of Supervisors on May 18, 1950 as amended: for purpose of <br /> promoting the public health, safety and general welfare by regulating, restricting and deter- <br /> mining the location of trades and industries, the location, height, bulk, number of stories, and <br /> size of buildings and other structures, the percentage of lot which may be occupied, the size <br /> of yards and other open spaces, the density of population, the location of buildings designed <br /> for specific uses the areas along natural water courses, streams and creeks in which trades and <br /> industries and the location of buildings for specific uses may be prohibited; establishing set- <br /> back lines; and establishing districts of such number, shape and area deemed best suited to <br /> carry out the purposes of this ordinance as it applies to lands outside the limits of incorpo- <br /> rated cities and villages in Dane County; and providing penalties, pursuant to the authorization <br /> of Section 59.97, 59.971, 59.99 and 87.30 of the Wisconsin Statutes. The Dane County Board of <br /> Supervisors do ordain as follows: <br /> 10.01 DEFINITIONS: For the purposes of this ordinance certain terms used herein are defined <br /> as follows: <br /> (1) Accessory Building: A subordinante or supplemental building, the use of which is in- <br /> cidental to that of the main building on the same lot or the use of the premises on <br /> which it is located. <br /> (2) Accessory Use: A use customarily incidental and accessory to the principal use of a <br /> lot or parcel, or building or structure on the same lot or parcel as the principal <br /> use. <br /> (3) Animal Unit: One animal unit shall be defined as being the equivalent of one cow, <br /> four hogs, ten sheep, ten goats, one hundred poultry, one horse, one pony or one <br /> mule. <br /> (4) Apartment House: A building containing accomodations for more than two families <br /> living independently of each other. <br /> (5) Apartment House Complex: A group of apartment houses, located on a single parcel of <br /> land with certain facilities, such as driveways, parking spaces and the like, common <br /> to the buildings in the complex. <br /> (6) Boarding House: A building or premises where meals are served by prearrangement for <br /> definite periods of time for compensation for five (5) or more person, but not ex- <br /> ceeding twenty (20) persons, not open to transients, in contradiction to hotels and <br /> restaurants open to transients. <br /> (7) Building: Any structure having a roof supported by posts, columns or walls and <br /> its appendages including balconies, porches and used or intended to be used for <br /> the shelter or enclosure of person, animals, equipment, machinery or materials. <br /> Also included for permit and locational purposes are swimming pools both above <br /> and below ground, towers for microwave antennas, community television antennas <br /> but not for towers and posts for lines carrying telephone messages or electricity. <br /> (8) Building Height: The vertical distance, measured from the mean elevation of the finished <br /> grade along the front of the building to the highest point on the roof for flat roofs; <br /> to the mean neight level between the eaves and the ridge for gable and hip roofs; to <br /> the deck line for mansard roofs. <br /> (9) Building Line: The building line shall be the point at which the building wall <br /> or any appendage of the building such as steps, chimneys, decks, porches or <br /> covered patios meet the ground. For earth sheltered homes, the building line is <br /> a line where the exterior walls of the building if extended vertically would be <br /> located on the lot. <br /> (10) Building Setback Line: is a line that is parallel to the front or street lot line <br /> and is located at a distance from either the centerline of the adjacent highway <br /> or the front lot line as provided for in ss 10.17 of this ordinance. For triangu- <br /> lar or gored lots that do not have the required lot width at the required building <br /> setback line, the building setback line shall be a line that is parallel to the <br /> front lot line or if the front lot line is a curve it shall be parallel to the chord <br /> of the arc of the curve of the front lot line and located at the point on the lot <br /> where the length of the lines meets the lot width requirements of the zoning district <br /> in which it is located. SEE ALSO LOT WIDTH. <br /> (11) Campground: A parcel or tract of land, maintained, intended or used for the purpose <br /> of supplying temporary or overnight living accomodations to the public by providing de- <br /> signated areas for the placement of trailers tents, buses, automobiles or sleeping bags, <br /> and may include buildings to provide services to the patrons such as restrooms, bathing, <br /> laundry and commissary facilities. A primitive campground shall be any area or site <br /> designated for camping purposes which is accessible only by hiking, boating or canoeing. <br /> - 1 - <br />
