(2) Any building lawfully erected prior to the adoption of this ordinance which does not
<br /> conform to the requirements of this ordinance as to setback, side yards or rear yards,
<br /> may be continued in use, but any future additions or structural alterations shall con-
<br /> form to the provisions of this ordinance.
<br /> (3) Any existing non-conforming use may be changed to another non-conforming use of a
<br /> similar or more restricted classification or to a conforming use; provided, however,
<br /> that when a use has been changed to a conforming use of a more restricted non-con-
<br /> forming use it may not again be changed to a less restricted use.
<br /> (4) No use which is not the principal use of the land on which it is located shall be con-
<br /> sidered a valid non-conforming use.
<br /> (5) Any non-conforming use, the location of which is changed to another part of the pre-
<br /> mises shall be considered abandoned 1 year after the locational change and, in any
<br /> event, any non-conforming use at the new location shall be invalid.
<br /> 10.22 INTERPRETATION AND APPLICATION
<br /> (1) In interpreting and applying the provisions of this ordinance they shall be held to be
<br /> minimum requirements for the promotion of health, safety, convenience, morals, comfort
<br /> and general welfare. It is not intended by this ordinance to interfere with or
<br /> abrogate or annul any easements, covenants, or similar agreements between parties, nor
<br /> is it intended by this ordinance to repeal, abrogate, annul or in any way impair or inter-
<br /> fere with any existing provisions of law or ordinance, or any rules, regulations or per-
<br /> mits previously issued or adopted, or which may be issued or adopted according to law
<br /> relating to the use, occupancy, location or height of buildings or premises; provided,
<br /> however, that when this ordinance imposes a greater restriction upon the use, occu-
<br /> pancy, location or height of buildings or premises than imposed by such existing pro-
<br /> visions of law or ordinance, or by such rules, regulations, or permits, the provisions
<br /> of this ordinance shall control.
<br /> 10.23 COMPLETION, RESTORATION OR ENLARGEMENT OF EXISTING STRUCTURES
<br /> (1) Nothing herein contained shall require any change in the plans, construction or intended
<br /> use of a building or premises for which plans have been prepared heretofore, and the
<br /> construction of which shall have been diligently pursued within three (3) months after
<br /> the effective date of this ordinance.
<br /> (2) Nothing herein contained shall prevent the alteration, restoration or repair of any
<br /> building occupied by a non-conforming use at the effective date of this ordinance;
<br /> provided, however, that the cost of such alteration, restoration or repairs shall not
<br /> during the life of the building exceed fifty (50) percent of the assessed valuation
<br /> of such structure or building, such valuation being that in effect for the year in
<br /> which such use became non-conforming.
<br /> (3) Nothing herein contained shall prevent the restoration of a non-conforming building
<br /> or structure destroyed by fire, explosion, act of God or act of public enemy, pro-
<br /> vided, however, that if such destruction shall exceed fifty (50) percent of the assessed
<br /> valuation of such structure for the year in which such destruction occurs, the future
<br /> use, location,height, setback, rear and side yards shall conform to this ordinance.
<br /> 10.24 CHANGES AND AMENDMENTS
<br /> (1) The Dane County Board of Supervisors may from time to time later, supplement or change
<br /> by ordinance the boundaries or classification of districts designated in this ordinance,
<br /> or any of the provisions or regulations imposed by this ordinance in the manner provided
<br /> by law.
<br /> 10.25 ADMINISTRATION, ENFORCEMENT AND PENALTIES
<br /> (1) ZONING ADMINISTRATOR
<br /> (a) The provisions of this ordinance shall be administered by or under the Zoning
<br /> Administrator, who in person or by duly authorized deputy or assistant shall
<br /> have the right to enter upon premises affected by this ordinance at reasonable
<br /> hours for the purpose of inspection. The Zoning Administrator shall hold his
<br /> office under civil service, and vacancies insuch office shall be filled by proce-
<br /> dures established by Civil Service Ordinance. The County Executive shall be the
<br /> appointing authority for the position of Zoning Administrator
<br /> (b) It shall be the duty of the Zoning Administrator to receive applications for zoning
<br /> permits and such other permits and licenses provided in this ordinance, and to issue
<br /> such permits after applications have been examined and approved; to inspect buildings
<br /> under construction for compliance with the regulations of this ordinance; to make
<br /> periodic inspections; to take such action as may be necessary for the enforcement of
<br /> the regulations provided herein; to attend all meetings of the Zoning Committee and
<br /> the Board of Adjustment; and to perform such other duties as the Zoning Committee and
<br /> the Board of Adjustment may direct. _
