10.20 JUNK OR SALVAGE YARDS <br /> (1) USE <br /> (a) For purpose of this ordinance, any premises used for the storage, gathering or sale <br /> of junk or salvage, as defined in this chapter, shall be considered a junk yard. <br /> It shall not be necessary that a commercial purpose exist before a violation of <br /> this Chapter can be found. <br /> a. Junk or salvage, as defined under this Chapter, shall be permitted to be <br /> stored on any premises on which a permitted business enterprise is actu- <br /> ally conducted; provided however, that all such junk or salvage is actually <br /> used in the conduct of such permitted business enterprise; and provided <br /> further, that all such junk or salvage is at all time stored in an enclosed <br /> building on the premises, secure from public view. <br /> b. Junk or salvage, as defined in this Chapter, shall be permitted to be stored <br /> on any premises used chiefly for residential purposes; provided, however, <br /> that all such junk or salvage is stored solely for eventual use on the pre- <br /> mises; and provided further, however, that all such junk or salvage is at <br /> all times stored in an enclosed building, secure from public view. <br /> (2) LOCATION AND BOUNDARIES <br /> (a) No junk or salvage yard shall be located within two hundred (200) feet of the <br /> boundary of a residential, rural homes or local business district, and no opera- <br /> tion in connection with such business shall be carried on within one hundred 1 <br /> fifty (150) feet of any street, road or highway. <br /> (b) All junk and salvage yard shall meet the minimum standards for such yards as pro- <br /> vided in NR 51, State of Wisconsin Solid Waste Disposal Standards, Department of <br /> Natural Resources, Division of Environmental Protection. <br /> (3) LICENSE <br /> (a) Before any premises may be used as a junk or salvage yard, the same shall be licensed. <br /> Application for such license shall be made to the Zoning Administrator, setting <br /> forth the description of the premises to be licensed, the nature of the business <br /> and the materials to be handled, the type of construction of any building to be <br /> used in connection with the business, the applicant's name or names, officers, if <br /> ' any, and address of each. The application of license shall be referred to the - <br /> Zoning Committee, which shall within a reasonable time, hold a public hearing, <br /> notice of which shall be given by a Class 2 notice under Chapter 985, Wisconsin <br /> Statutes. If, after such public hearing, the Zoning Committee shall find that all <br /> details of the premises and buildings are in conformity to the provisions of this <br /> ordinance, and the site is suitable for the conduct of such business, the Committee <br /> shall authorize the issuance of a license. The license fee shall be ten dollars <br /> ($10.00) per year and such license shall expire on July 1 of each year. Licenses <br /> may be renewed from year to year on authorization of the Committee when inspection <br /> discloses that the business is being conducted in accordance with the provisions <br /> of this ordinance. <br /> (b) Revocation of license. Upon the complaint of any interested person, or on its own <br /> motion or inspection discloses that the provisions of this ordinance are being vio- <br /> lated, the Zoning Committee may hold a public hearing to determine whether a junk <br /> yard license shall be revoked, notice of such hearing to be given to all interested <br /> parties. After public hearing, the Zoning Committee may order such junk yard license <br /> revoked. <br /> (c) Should any town elect to license a salvage yard by adoption of an ordinance pur- <br /> suant to the provisions of Section 59.07 (38) of the Statutes and file a copy <br /> of such ordinance with the Zoning Department then the provisions of paragraphs <br /> (a) and (b) above shall not apply, but no such license shall be issued by any town <br /> for such purpose unless the area is property zoned and unless the Zoning Committee, <br /> after public hearing, shall determine that the site is suitable. When a salvage <br /> yard is licensed by the town then the responsibility of controlling such salvage <br /> yard will rest with the town. <br /> 10.21 NON-CONFORMING USES <br /> (1) The lawful use of a building or premises existing at the time of adoption of this ordi- <br /> nance may be continued as a non-conforming use, but if such non-conforming use, shall <br /> - 40 - <br />
