10.25 ADMINISTRATION, ENFORCEMENT AND PENALTIES.
<br />(1) Zoning Supervisor.
<br />(a) The provisions of this ordinance shall be administered by or under
<br />the direction of the zoning supervisor, who in person or by duly authorized
<br />deputy or assistant shall have the right to enter upon any premises affected
<br />by this ordinance at reasonable hours for the purpose of inspection. Such
<br />zoning supervisor shall be appointed by the zoning committee for a term
<br />of two (2) years with the approval of the county board and his compensa-
<br />tion shall be fixed by the county board in the same manner as the salaries
<br />of other county employees. The zoning committee may require new
<br />appointees to the office of zoning supervisor to. serve such probationary
<br />period as they deem necessary.
<br />(b) It shall be the duty of the zoning supervisor to receive applica-
<br />tions for building permits and any other permits or licenses provided
<br />in this ordinance, and to issue such permits after the applications have been
<br />examined and approved; to inspect buildings under construction for com-
<br />pliance with regulations of this ordinance; to make periodic inspections;
<br />to take such action as may be necessary for enforcement of the regulations
<br />provided herein; to attend all meetings of the zoning committee and the
<br />board of adjustment; and to perform such other duties as the zoning com-
<br />mittee and the board of adjustment may direct.
<br />(2) Building Permits. .
<br />(a) No new building may hereafter be erected, and no existing build-
<br />ing shall be added to, structurally altered, moved or changed in use, nor
<br />shall any non - conforming building be repaired, until a building permit
<br />shall have been issued, except as otherwise provided by law or ordinance.
<br />(b) Permits are required for the following:
<br />1. New construction, structural alterations, change in use and addi-
<br />tions to any existing building, or the moving on or onto the premises of
<br />any such building, in all districts except agricultural.
<br />2. All of the provisions enumerated in the preceding paragraph shall
<br />require permits in the agricultural district with the exception of accessory
<br />buildings used in connection with farming.
<br />3. The repair or restoration of any non - conforming building.
<br />4. Signs and billboards, except those which advertise a business con-
<br />ducted on the premises.
<br />(c) The zoning supervisor may require the filing of a scale drawing
<br />of the premises, showing the dimensions of the lot or parcel, the dimensions
<br />of the proposed building, the distance in feet from the abutting street or
<br />highway and- from the side and rear lot lines, the size and location of any
<br />existing buildings, and such other information as he deems necessary.
<br />The zoning supervisor shall not be responsible for determining the loca-
<br />tion of lot lines.
<br />(d) Applications for ppermit must contain the following: name and
<br />address of the owner of the property,'legal description, size and location
<br />of the buildings to be erected or moved on or onto the property, proposed
<br />use of the building or premises, type of construction, estimated cost, and
<br />such other information as the zoning supervisor may require.
<br />(e) Such application shall be signed by the owner or -his duly author-
<br />ized representative or agent; provided, however, that if a prospective
<br />owner desires a prior ruling on a proposed construction or use before
<br />consummation of purchase, he may apply for a permit, and if such permit
<br />be denied, he may appeal to the board of adjustment.
<br />(f) Coincident with the issuing of a permit the zonng supervisor shall
<br />Ea card, certifying that a permit has been issued. Such card shall
<br />bear the same number as the permit and identify the construction. and

<br />premises covered by the permit. Such card shall be posted in a conspicu-
<br />ous place on the premises during construction, and no construction shall
<br />be begun until such card has been posted.
<br />(g) Fees for building permits shall be as follows:
<br />For construction up to and including $ 500 .............. ..............................$ 1.00

<br />For each additional $1,000 of construction over $2,000 ........................ .50

<br />Such fees shall be collected by the zoning supervisor at the time the
<br />permit is issued, and shall be accounted for and paid into the general
<br />fund of the county as other moneys collected by the county. The county
<br />zoning supervisor shall issue a receipt for each fee collected.
<br />(3) Zoning Committee.
<br />(a) A zoning committee is hereby created, pursuant to the provisions
<br />of Section 59.97 (2) of the statutes. This committee shall consist of three
<br />(3)' members, appointed by the chairman of the county board and ap-
<br />proved by the county board from among the members of the county
<br />park commission. Initial appointments shall be for one, two and three
<br />years respectively, and thereafter such appointment shall be for three
<br />years, beginning on July 1, or until his successor shall have been ap-
<br />pointed and• qualified, with the term of one member expiring each year.
<br />Vacancies may be filled by the county board for unexpired terms. The
<br />compensation for members of the zoning committee shall be the same as
<br />that allowed to county board members for attendance at committee
<br />meetings.
<br />(b) It shall be the duty of the zoning committee to supervise the ad-
<br />ministration of the zoning ordinance; to hold hearings on proposed amend-
<br />ments to this ordinance and make recommendations thereon to the county
<br />board; to approve lats for record in accordance with the provisions of
<br />Section 236.06 (1) (b) of the statutes; and to perform such other duties
<br />in connection with zoning as may be delegated to it by the county board.
<br />(4) Penalties.
<br />(a) Any person, or persons, firm company, or corporation, either
<br />owner or occupant of the premises, who violates, disobeys, omits, neglects
<br />or refuses to comply with or who resists the enforcement of any of the
<br />provisions of this ordinance shall be subject to a forfeiture `of not to exceed
<br />two hundred dollars ($200.00) and costs, and in default of payment of. such
<br />forfeiture by imprisonment in the county jail until such forfeiture and costs
<br />are paid but not to exceed thirty (30) days. Each day that a violation is
<br />permitted to exist shall constitute a separate offense. Compliance herewith
<br />shall also be enforced by injunctional order at the suit of the county or
<br />occupant of real estate within the district affected by the regulations of
<br />this ordinance. It shall not be necessary to prosecute for forfeiture before
<br />resorting to injunctional proceedings.
<br />10.26 BOARD OF ADJUSTMENT.
<br />(1) Personnel, Term and Compensation.
<br />(a) The board of adjustment shall consist of three members, appointed
<br />by the chairman of the county board with the approval of the county
<br />board, each serving for a term of three (3) years beginning on July 1, with
<br />the term 'of one member expiring each year. Members shall reside within
<br />the areas of the county coming under the jurisdiction of this ordinance and
<br />no two members shall be from the same town. Compensation of members
<br />shall be the same as is allowed county board members for attendance at
<br />committee meetings.
