GENERAL ZONING ORDINANCE AMENDMENTS (2) <br />RESOLVE-1): <br />1. That the paragraph od Section 9 of the Dane County Zonings (rdinanee enacted on July 20, <br />1938, and amended on :larch 1o, 1939, entitled "Setback Lines Established", be and the same is <br />hereby repealed; <br />2. That there be added 'to the Dane County Zoning Ordinance a Section to be known as c) and tb <br />read as f ollays: <br />(1) Class "A" Highways: For'all highways marked on the official zoning m;tp as Class "A'" <br />ilighv;ays, setback lines, located p rallel -to and distant one hundred (loo) feet from-the center <br />line of the highscay, are hereby established. The follaving highways are hereby ddz;ignated as <br />Class "i1"' iighways: <br />United States lighways Nos. 12, 14, 18, 51, 151. <br />State Trunk highways Nos. 13, 19, 30, 591 731 10i�'), 113, <br />County Trunk Highways "Mir, from the north limits of the village of Verona to its inter- <br />section with State Trunk Tlighwly No, 113; and "S" from the ~vest limits of the city of M.1dison <br />to its eastern intersection with County Trunk Highway ":.I'". <br />The follaving proposed high;^.ays shorn on the off icial.zoning map: <br />The proposed highway to serve United States Highway No. 51 frog•, its intersection with <br />United States Highway Nos. 12 anti 18 north7ard to its intersection with United States High- <br />way No. 151. <br />The proposed highway to serve United Stages Highway No. 12 from its intersection with <br />United States Highway Nos. 12 and 18, Sec. 35 T.7 11.111. 9 E., westward to its intersection <br />with United States Highway 110. 12 in See. :, �.7 11., r 8 E. <br />The proposed relocation of State Trunk Highr,ay No. 113 from the southeast corner of the <br />village limits of Waunakee southeasterlj to the ncm•th limits of the city of rkidison. <br />(2) Class "B" lliglmvays: All higlfvays on the county trunk higlmray systerq of Dane county except <br />those highways classified as Cl.ss "A" Iliglnvays are hereby designated is-Class "B" .Tliglm)ays. For <br />all Class "B" llirglnvays, setback lines located parallel to anti distant 75 feet frpm the center line <br />of t high7ay_.are hereby e5tablis'.:ed. _ <br />(3) Class .!'.C" .Highways: Streets less •than_sinty_: i (56) feet+ ;i in platted subdivions <br />ty' recorded_ previous to the passage of this ordinance, are hereby designated as Class "C" Highways. <br />For all Class F "C" highways, setback lines parallel to and distant twenty (20) feet from the <br />front line are hereby established, provided, havever, that if highways iuider this section are X <br />part of the county trunk system of Dane county, then setback lines of said hirbr,ays shall be the <br />L.,.same as in Class "B" }ligln�a°y, _�- <br />(4) Class "D" highways: All highways in Dane county not otherwise classified are hereby _ <br />designated as Class "D" Highways. For all Class "D" ilightvays, setback lines parallel to and <br />distant thirty (30) feet from the higliwa,y right of way are hereby established, provided, hav- <br />ever, that if highways under this section are a part of the county trunk higlmvay system of Dane <br />county, then setback lines of said higlnvays stall be' the same as in Class "B" lligln-,ays. <br />In no case shall the setback lines in Class: "A" or Class "B° .11ighsays be located less than <br />f arty two feet from the highway right of way line, <br />When the location of two or more highways of different classifications are coincidental, the <br />greater setback shall apply. <br />Anerdemt: :,dopted by the Dane County Board October 83, 1940, <br />RESOLVED: that the Dane County Zoning Ordinance be amended oy adding a new section thereto <br />to be :mown as Section VIIIA which shall read as followg: <br />8. .'To person, firw, or corporation shall engage.i.n the nuszr._ss of ouying,- selling, vather- <br />,ing, delivering or staring of old ,iron, paper, rags or any other material generally Ana common- <br />ly ,included within the term °junk" or cowmonl•• de'ait withAn the business generally called <br />"junk yard" or.in the business of operating an automobice wrecking yard or in the nus:ness of <br />storing, buying, se.11i.nF, gathering, or delivering of any material or equipment of any :rind or <br />nature by whatever name known or described by or .included .-n the terms .'salvage yard" or <br />"sa.lvage ".in an; •town.in Dane County wherein the Dane County Zoning Ordinance has been adopted <br />without having first obtained a license therefore as prcviclea.in this section. Every such <br />license shall expire on the 1st day cf November following the date of its.issuance. <br />.II. Definitions: .'henever the following terms are used,in this section, they shall be <br />construed as follows: <br />a. "Junk" shall mean any old or used metal regardless ofkind or condition, paper, rags, glass <br />or glass products, rubber or rubber sabStitates, used building materials of whatever kind, <br />nature or description, or any other commodity regard lass of name, kind, nature, or description <br />which has been discarded, and any other. mate risI or substance commonly understood to be included <br />within the term "junk ". <br />b. "Junk business" shall mean the buying, selling, gathering,, delivering or storing of junk. <br />c. "Junk yard" shall mean the place of business where the junk business is carried on. <br />d. "Junk dealer" shall mean-any parson, firm, or corporation, that buys, sells, gaethers, <br />delivers, or stolas junk, regardless of whether or not he operates and maintains a junk yard <br />therefore.' <br />a. "Automobile wrecking yard" and "salvage yard" shall mean the buying selling, gaeyering, <br />delivering, storing, wrecking, rebuilding, or any other dealings of any kind, nature or descrip- <br />tion, with used automo6i lee' or any other used motor vehicle, or any part of any used automobile <br />or any other used motor vehicle, intending hereby to include every part of any kind of usea motor <br />vehicle without specific gnumoration. <br />I-11. Application for such license shall be made to the County Clerk upon blanks which shall <br />be provided by the said clerk and shall be accompanied by the fee herein required. Such <br />application sh &ll set forth the full name and residence of the applicant, and in case of a <br />firm, the full ,names, residences, and positions of the members of the firm, and shall describe <br />particularly the lot or parcel of land, if, an,;, upon which junk is to be collected, a junk yard, <br />an automobile wrecking yara, or a salva;;e yard is to be operated or where junk or salvage is to <br />be collected, stored, sold, or delivered, or which.is to be used in connection with the conduct <br />of such businesses, regardless of whee her such businesses or such operations are conducted <br />within a building or wheeher or not subh junk salvage automobiles, or salvage .is__ combustible or <br />incombustible, and shall also contain such ot6r information as may f fom time to time be <br />
