<br />4. An appeal shall'stay all proceedings in the fur –
<br />- therance of the action appealed from, unless the Per-
<br />son performing such act shall certify to the admin-
<br />istrative officet that such stay would cause iminent
<br />peril to life or property, and the administrative
<br />officer in turn certify to the board of adjustment,
<br />is which case the action shall not -be stayed otherwise
<br />than by a restraining order issued either by the board
<br />of adjustment or a court of record. In case an .act ion
<br />is not stayed the county shall not be liable for any
<br />damages' resulting through continuance of such action
<br />pending decision on the appeal.
<br />(b) Special Exemptions.
<br />During periods of national or local emergency, or
<br />where unusual conditions or circumstances ecist, the
<br />board of adjustment shall have the power to grant spe-
<br />cial exemptions from the terms of this ordinance as
<br />will not be contrary to the public interest or the
<br />general intent of this ordinance. A time limit may be
<br />fixed by the board for the period during which such
<br />special exemption may continue in effect. Application
<br />for such special exemption may be made by any person
<br />affected, either to the administrative office or di-
<br />rectly to the board of adjustment, but the board shall
<br />grant any such special exemption only after a public
<br />hearing held in accordance with the,procedure provided
<br />for hearing appeals.
<br />'10.26 Severability of Ordinar_ce Provisions.
<br />(1) The several terms and provisions of this ordi-
<br />nance shall be deemed severable, and if any provision
<br />of this ordinance or its application to any person or
<br />circumstance shall be held to bo invalid, the remainder,
<br />of the ordim,.nce and 'its application to other per-
<br />sons and - circumstances shall not be, affected thereby.
<br />10.27 Definitions.
<br />For the purposes of this ordinance certain terms
<br />used herein are defined as follows:
<br />(1) Accessory Building; A subordinate or supplemental
<br />building or portions of the main building, the use of
<br />which is incidental to that of the main building on
<br />the same lot or parcel, or to the use of the premises
<br />on which, it is located.
<br />(2) Accessory Use: A use customarily incident and
<br />accessory to the principal use of 'a lot or parcel, or
<br />'building or structure located on the same lot or
<br />parcel as the principal use.
<br />(3) Block: That property abutting on one side of a
<br />street between the two nearest intersecting streets,
<br />railroad right of Wray, or other natural barriers;
<br />Provided, however, that where a street curves so that
<br />any two chords, thereof form an angle of one hundred
<br />twenty degrees (120) or less measured on the lot side,
<br />such curve shall be considered an intersecting street.
<br />4. Boarding House: A building or premises where meals
<br />are served by prearrangement for definite periods for
<br />.compensation for five (5) or more persons, but not
<br />exceeding twenty (20) persons, not open to transients,
<br />in contradistinction to hotels or restaurants open
<br />to transients.
<br />(5) Building: Anything constructed or erected the
<br />use of which requires more or'less permanent location
<br />on the ground, \The building area of any building
<br />ahall be that area,bounded by the exterior dimensions
<br />of the outer wall at the ground line.
<br />(6) Building Height: The vertical distance, measured
<br />from the mean elevation of the finished grade along
<br />the front of the building to the highest point on the
<br />roof for flat roofs ;, to the mean height level (be-
<br />tween the eaves and ridhe) for gable and hip rroofs;
<br />to the deck line for mansard roofs.
<br />(7) Building Site''Area: The ground area of a build-
<br />ing or buildings, together with all open spaces, as re-
<br />quired by this ordinance.
<br />(8) Tlub: An association of come common purpose, but
<br />not including a group organized primarily or wbich is
<br />actually engaged to render a service which is custom-
<br />arily carried on as a business. A road house or tavern
<br />shall not be construed as a club.
<br />(?) Dwelling:
<br />(a) Single Family Dwelling: A building designed for
<br />and occupied exclusively as a residence of one family.
<br />(b) Multiple Family Dwelling: A building designed or
<br />used or intended to be used by two or more families
<br />living independently of each other.
<br />(10) Family: Any number of individuals related by
<br />blood or marriage, or not to exceed five poisons .aot
<br />so related; living/ together on the premises as a
<br />single housekeeping unit, including any domestic
<br />servants.
<br />(11) Garage, Private: An accessory building or
<br />accessory portion of the main building, used, or do—
<br />signed or intended to be used for the storage of
<br />private motor vehicles belonging to the family or
<br />families residentlon the promises, and in which -no
<br />business service or industry connected directly or in-
<br />directly with motor vehicles is carried on, and provided t
<br />that not more than one –half of the.space may be rented
<br />for the private vehicles of persons not resident 'on the
<br />premises, except-that all of the space in a garage
<br />having a capacity of not more than two cars may be so
<br />rented. Not more than one commercial vehicle shall be
<br />stored in such garage and such commercial shall not ex-
<br />ceed two (2) tons capacity and must belong to a family
<br />or member of a family resident on the premises.
<br />(12) Garage, Public: Any building, structure or prem-
<br />ises used for the repair, servicing' or storage'of
<br />motor vehicles for the general public. No building or
<br />premises used exclusively for the sale,'or dispaly
<br />for sale, of motor vehicles or trailers, where no re-
<br />pairs or mechanical work is done, shall bei considered
<br />a public garage for the purposes of this ordinance.
<br />(13) Home Occupation: any occupation for gain or
<br />support conducted entirely and only by members of the
<br />family resident within a residential building and when
<br />the space occupied is incidental to the residential
<br />use of the building and when the occupational use is
<br />incidental to the residential use of the building or
<br />premises; provided that no articles may be sold or
<br />offered for sale except those produced on the premises;
<br />and no articles may be displayed so as to be visible
<br />from the street or highway and no advertising may be
<br />placed except as otherwise herein provided.. Home .
<br />occupations may include such,uses as doctors and den-
<br />tists, artists, music teachers, weaving, knitting,
<br />dressmaking, and similar activities, but not includ-
<br />ing such uses as barber shops and beauty parlors, or
<br />the buying and selling of any article;, provided, how-
<br />ever, that raw materials, or partially finished arti-
<br />cles may be bought, and after completion, may be sold,
<br />provided that the value of the article shall have been
<br />increased by fifty (50) per cent or more by reason of
<br />the work done on it.
<br />(14) Hotel: A building in which board and lodging are
<br />provided to the transient public for compensation.
<br />(15) Lodging House: A building in which lodging accom-
<br />odations are offered by prearrangement and-'for definite
<br />periods of time to four or more, but not to exceed
<br />twelve, individuals, not members of the family.
<br />(16) Lot: A parcel of land occupied or designed to
<br />be occupied by one,building and its accessory buildings
<br />or uses, including the open spaces required by this
<br />ordinance. A lot may be a parcel designated by-number
<br />on any plat or assessors plat recorded in the office
<br />of the register of Deeds for Dane county, or any parcel
<br />described i.n a .separate deed recorded in 'the office of
<br />the register of deeds, or any part of a larger parcel
<br />when such part complies with the requirements of this
<br />ordinance for frontage and area of the district in
<br />which it is located. No land included in any street,
<br />highway or railroad right of way shall be included in
<br />computing lot area.
<br />(171 Lot, Corner: A -lot located at the intersection
<br />of two streets, or a lot bounded on two sides by
<br />crossing or intersecting streets,, any two corners of
<br />which have an angle of one hundred twenty (120) degrees
<br />or less, or by a curved street an two chords of which
<br />on the' inside of the curve form an angle of one hundred
<br />twenty (120) degrees or less.
<br />(19) Lot, Interior: A lot abutting on one street or
<br />on two streets at opposite ends of the lot.
<br />(19) Lot Line:•The lines bounding a lot as defined
<br />herein. For purposes of this ordinance no such lot
<br />lines shall lie within the right of way of a street,
<br />higiv ay or railroad right of way.
<br />(20) Lot tfidth: For purposes of this ordinance the
<br />width of a lot shall be the•distaace between the side
<br />lines at the setback line.
<br />(21) Non – Conforming Use: A building or premises
<br />occupied by a use which does not conform to the regu-
<br />lations of the district in which it is located.
<br />(22) Parking Lot: A lot where automobiles are parked
<br />or stored temporarily, but not including the wreck-
<br />ing of automobiles or other vehicles or storage for
<br />the purpcse'of repairing or wrecking.
<br />(23) Person: Except when otherwise indicated by the
<br />context, the word person shall 'include the plural, or
<br />a company, firm, corporation or partnership.
<br />(24) Professional Office: When conducted in a resi-
<br />dential district a professional office shall be inci-
<br />dental to the residential use of the premises; 'shall
<br />be conducted by, -a member of the resident family en-
<br />tirely within a residential building;, and shall in-
<br />clude the offices of doctors and practitioners, mini-
<br />sters, architects, landscape architects, professional
<br />engineers, authors, musicians and other r ecognized
<br />professional occupations conducted within the premises,,
<br />but not including personal services, such as barbers,
<br />beuticians and similar occupations.
<br />(25) Recreational Camp: An area containing one or
<br />more permanent buildings used seasonally or periodi-
<br />cally for the accemodation of members.of associations
<br />or groups for recreational purposes. ' ,
