,v The board of adjustment shall have ti -o following poTfors: r" a. To hear and decide appeals whore it is allo{ed there is an error in any order, requirement, decision or determination made by an administrative official. b. To hear and decide special exomptions to tho terms of this ordinance. c. Where there are practical difficulties or iLnnbceosary hardships in the way of carrying out the strict lettor of this ordinance, the board of adjustment shall have the power, in passing upon appeals, to aut'zorizo such variance from the terms of this ordinance as will not be contrary to the public interest and so that the intent bf the ordiance shall be observed and subotar_tial justice done, provided, however, that no such variance shall have the effect of allowing, in any district, uses prohibited in that district. d. Grant a permit for a temporary building for commerce or industry in a district which is incidental to the residential devolopemont but no such permit shall be grantedd for•. a period of more than one (I) _ -year. c. Grant a permit for the erection and use of a building or premises in any loca- tion to a public service corporation or for a public utility purpose . which the board finds reasonable necessary foV the public convenience, safety or welfare. f. To grant a permit for the location of an otherwise hazardous or noxious or offensive use in the Industrial District when, in the opinion of the Board, the ,hazards attendant on such use are removed by reason of its proposed location. SECTION XV CHANGES A10 AIEMMEITTS The County Board of Supervisors of Dane County, Wisconsin, may, from time tom. _ �MI-ve, alter, supplement or change the boundaries and regulations contained in th- -rr'- -or - -o nance in the manner provided'by lawn ;n. SEGTJON XVI VIOLATIOIv MID PENALTY -The provisions of this ordinanco shall be onforced by or under the direction of �-hc county board of supervisors. any person_, firm, association or corporation who violates, disobeys, omits, ncglocts or refuses to comply with or resists the enforcement of any of the provisions of this ordinance shall, upon conviction thereof, be subject to a fine of not less than ten ($10.00) dollars, nor more than two hundred ($200.00) dollars, together with the costs of the action, or by imprisonment in the county jail of Dane County for a term of not more than thirty (30) days and evory. day of violation shall constitute a separate offense. _ Compliance therewith may also be enforced by injuctional order at the suit of 'the county or the owner or ozsmers of real estate within the district affected t the regulation of this ordinanco. SECTION XVII - SAVING CLAUSE The several terms and provisions of this ordinance shall be deemed severable, aftd if any provision of this ordinance or the application thereof to any person or circumstances is held invalid, the remainder of the ordinance and the application of such provision to other persons and circumstances shall not be affected thereby. SECTION XVIII - REPEAL OF CONFLICTING ORDINANCES All ordinances or parts of ordinances in conflict with the terms of this ordinance are hereby repealed. SECTION XIX s EFFECTIVE DATE This ordinance shall become effective immediately on publication. 10
