C. County Standard. Where the SUBRECIPIENT is not certified, licensed, or <br />otherwise regulated, and COUNTY wants to apply a specific set of standards to <br />SUBRECIPIENT, the same are specified in this Agreement. <br />D. Background Checks. SUBRECIPIENT agrees to do background checks for all <br />employees having regular contacts with children, elderly or vulnerable adults. <br />E. Notification. SUBRECIPIENT shall notify the COUNTY promptly, in writing, if it is <br />unable to comply with any of the above State or Federal requirements. <br />XXV. LIVING WAGE <br />A. SUBRECIPIENT agrees to pay all workers employed by the SUBRECIPIENT in the <br />performance of this Agreement, whether on a full-time of part-time basis, the <br />prevailing living wage as defined in section 25.015 (1) (f), Dane County Ordinances. <br />SUBRECIPIENT agrees to make available to COUNTY inspection SUBRECIPIENT's <br />payroll records relating to employees providing services on or tinder this Agreement <br />or subcontract. <br />B. If any payroll records of SUBRECIPIENT contain any false, misleading, or fraudulent <br />information, or if SUBRECIPIENT fails to comply with the provisions of section <br />25.015 of the Dane County Code of Ordinances, COUNTY may withhold payments <br />on the Agreement, terminate, cancel, or suspend the Agreement in whole or in part, <br />or, after a due process hearing deny SUBRECIPIENT the right to participate in <br />bidding on future county contracts for a period of one year after the first violation is <br />found and for a period of 3 years after a second violation is found. <br />C. SUBRECIPIENT agrees to submit a certification as required in section 25.015 of the <br />Dane County Code of Ordinances. <br />D_ SUBRECIPIENT agrees to display COUNTY's current living wage poster in a <br />prominent place where it can easily be seen and read by persons employed by <br />SUBRECIPIENT. <br />E. SUBRECIPIENT shall ensure that any subcontractors conform with the provisions of <br />this section. <br />F. The following are exemptions from the requirements of this section: <br />When the Maximum Cost of the Agreement is less than $5,000; <br />ii. When the SUBRECIPIENT is a school district, a municipality, or other <br />unit of government; <br />iii. When the County is purchasing residential services at an established per <br />bed rate; <br />iv. When employees are persons with disabilities working in employment <br />programs and the Subrecipient holds a current sub -minimum wage certificate <br />issued by the U.S. Department of Labor or where such a certificate could be <br />issued but for the fact that the employer is paying a wage higher than <br />minimum wage; <br />V. When an individual receives compensation for providing services to a <br />family member; <br />Page 14 <br />
