b) Insurance and security. The written evaluation will also include an <br />analysis of the ramifications of including Dane County as an "additional <br />insured" on Enbridge's Commercial General Liability Insurance. <br />4) Provider will provide a written summary comparing the sections of Enbridge's <br />current General Liability insurance policy referenced in #1, above, with the <br />insurance policy forms that are currently being litigated over the 2010 Enbridge <br />spill in Michigan. <br />a) To evaluate if the current insurance coverage carried by Enbridge is <br />different than the insurance currently involved with coverage litigation over <br />costs associated with the Enbridge Pipeline spill in Michigan, the Provider <br />shall obtain the following documentation: <br />i. A copy of the complaint regarding the coverage litigation <br />ii. A Copy of the reservation of rights letters from the insurance <br />company denying the claim from the Michigan spill. <br />If necessary, Provider shall sign a confidentiality agreement with Enbridge <br />regarding any trade secrets or proprietary information that may be <br />included in the above documentation. <br />5) Based on the evaluation of Enbridge's existing insurance policies, provider will <br />provide a written determination of the suitability of said liability insurance policies <br />to cover the costs associated with a catastrophic spill in Dane County including <br />response, clean up, and remediation. The written determination will also address <br />the county's ability, if any, to submit a claim against the Enbridge insurance <br />policies on which the county may be listed as an additional insured. <br />6) Provider will make written recommendations on the appropriate type(s) and <br />amounts of insurance needed to cover costs of response, clean up, and <br />environmental remediation in the event of a catastrophic spill. <br />7) Provider will make written recommendations on the appropriate type(s) of <br />insurance and/or appropriate endorsement(s) needed for the county to submit a <br />claim for damages, and/or to cover costs of response, clean up, and remediation <br />in the event Enbridge is unable to fulfill its obligations as a liable party. <br />8) If separate environmental insurance is proposed by Enbridge, and/or required by <br />the County as a condition of permit approval, the Provider will make a written <br />determination on the adequacy of said insurance to address the coverage needs <br />for a pipeline spill. <br />9) Provider shall attend, subject to Provider's scheduling availability, future Zoning <br />and Land Regulation Committee meetings, as needed, to provide information, <br />respond to questions, and to present the findings of the written report. <br />10)Provider shall review all future insurance documents that may be submitted by <br />Enbridge as evidence of satisfying any conditions of approval of Conditional Use <br />Permit #2291 that may be required by the zoning committee.
