0 <br />ATTACHMENT A <br />TO MODIFY/REPLACE ARTICLE IV (D), VIII (A) AND VIII (B) <br />IV.D. *... be retained by the PROVIDER. PROVIDER shall provide a copy of all data <br />generated to the COUNTY for its unrestricted use. <br />VIII.A.PROVIDER agrees to provide liability protection for its officers, employees and <br />agents while acting within the scope of their employment. PROVIDER further <br />agrees to hold harmless COUNTY, its officers, agents and employees from any <br />and all liability including claims, demands, losses, costs, damages and expenses <br />of every kind and description (including death), or damages to persons or property <br />arising out of or in connection with or occurring during the course of this <br />agreement where such liability is founded upon or grows out of the acts or <br />omissions of any of the officers, employees, or agents of PROVIDER while <br />acting within the scope of their employment where protection is afforded by ss. <br />.893.82 and ss. 895.46(1) Wisconsin Statutes. <br />VIII.B.The State of Wisconsin and consequently the PROVIDER as an agency of the <br />State is self-funded for liability (both public and property) under s.893.82 and <br />s.895.46(1) of the Statutes. As a result, such protection as is afforded under <br />s.895.46(l), is applicable to officers, employees, and agents while acting within <br />the scope of their employment. Since this is statutory liability protection, there is <br />no liability policy as such that can extend protection to any others. <br />-7- <br />
