DANE COUNTY ORDINANCE AMENDMENT NO: 9748 <br />Amending Section 10.03 relating to Zoning Districts in the Town of Albion. <br />The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps <br />of the Town of Albion be amended to include in the RH-1 Rural Homes and A-2(2) Agricultural <br />district(s) following described land: <br />PETITION NUMBER: 9748 <br />PARCEL 1 TO RH-1 <br />Part of the NW 114 of the NW 1/4 of Section 1, T.5N., R. 12E., Town of Albion, Dane County, <br />Wisconsin, described as follows: Beginning at the Northeast comer of Dane County Certified <br />Survey Map number 8521; thence N89'00'1 0"E, 113.9 feet thence S31 °57'E; 255 feet thence <br />S87°00'W. 249 feet thence N00°00'18"E, 230 feet to the point of beginning. Containing 1.0 acre <br />more or less. <br />ALSO <br />PARCEL 2 TO A-2(2) <br />Part of the NW 114 of the NW 1/4 of Section 1, T.SN., R.12E., Town of Albion, Dane County, <br />Wisconsin, described as follows: Commencing at the Northwest corner of Dane County Certified <br />Survey Map number 8521; thence N89'00'1 0"E, 113.9 feet to the point of beginning; thence <br />continue N89°00'10"E, 77 feet; thence S3 1'57'E, 255 feet thence N87'E, 22 feet; thence <br />S00°00'18"W, 360 feet; thence S87°W, 480 feet; thence N00°00'18"E, 175 feet to the Southwest <br />corner of Dane County Certified Survey Map number 7446; thence N87°E, 414 feet; thence <br />NOO°E, 309 feet; thence N31 °57'W, 316 feet to the point of beginning. Containing 2.9 acres <br />more or less. <br />CONDITIONAL ZONING <br />Conditional zoning is hereby imposed pursuantto Section 10.255(3)(a)2.(b) of the Dane County <br />Code of Ordinances. The rezoned area shall be subjectto the following conditions. <br />This amendment will be effective if within 90 days of its adoption by Dane County the owner or <br />owners of the land record the following restriction(s) on said land: <br />1 - Deed restrictthe proposed A-2(2) parcel to prohibit residential development. <br />2. Deed restrict parcels 0512-013-9000, 0512-012-8140, and 0512-012-8512 to <br />prohibit residential development <br />Said restriction(s) shall run in favor of Dane County and the pertinent Town Board(s) as well as the <br />owners of land within 300 feet of the site. Failure to record the restriction(s) will cause the <br />rezone to be null and void. A copy of the recorded document shall be submitted to Dane <br />County Zoning. <br />The Dane County Board of Supervisors does ordain that this amendment, based upon Their findings, to be consistent <br />with the provisions of Wisconsin State Statute 91.77 (1)(a),(b),(c). <br />
