" 10.21(i)(d) Mineral extraction sites that were registered as nonconforming sites.as provided by this ordinance <br />shall not be considered abandoned or discontinued if the site is inactive for more than one year." <br />Since extraction activities are essentially unregulated at such sites, there is no enforcement mechanism to <br />ensure that operations are done in a manner that respects the rights and interests of neighboring property <br />owners and towns. <br />In our case, if the old quarry were to be reactivated, then we and other property owners around it need <br />assurance that we and our Town Board would have the opportunity to determine under what <br />circumstances and with what requirements it would be allowed to reopen.
