YOL .:C7 PAGE <br />of the portion in University Bay Drive. <br />. <br />Together with all of first.party's interest <br />in easement for sewer purposes across land <br />heretofore conveyed by first party to Nathaniel <br />W. and Virginia B. Sample,, but first party <br />makes no warranty as to this easement. <br />Subject to zoning ordinances, easements of <br />record, any utility easements and to the rights <br />of the public in all portions contained in <br />University Bay Drive. <br />The following provisions have been included by <br />first party in deeds which have heretofore con- <br />veyed certain lots fronting on University Bay <br />Drive out of a tract of greater depth owned by <br />her, which tract also included the land <br />described as Parcel No. 1, above; this deed <br />is given subject to the same provisions, to <br />apply to no more than that part of Parcel No. 1 <br />fronting on University Bay Drive, to a depth of <br />not more than 160 feet from the easterly line of <br />University Bay Drive, except that paragraph <br />number 7 set frth below shall in no event be <br />effective in any way: <br />1. All lots in said plat shall be used exclusively <br />for private dwelling purposes and no dwelling house <br />designed or intended to be used for more than.one <br />family shall be erected on said premises nor shall <br />any double house, two family house, duplex house <br />or apartment building be erected on or moved upon <br />said premises or suffered to remain there. <br />2. The line of any building or any part thereof, <br />erected on any lot or lots fronting on University <br />Bay Drive in the property owned by the party of <br />the first part, hereafter erected, shall not be <br />nearer the street than twenty-five feet. <br />3. No more than a one dwelling house shall be <br />constructed upon any Eighty (80) feet of frontage, <br />and no more than one (1) such dwelling on any <br />corner lot in said plat. <br />4. No building previously erected elsewhere shall <br />be moved upon any lot in said plat. <br />5. No out building other than a garage, erected on <br />any lot or lots in said plat, shall be nearer to <br />the front street line of said lot or lots than a <br />line drawn parallel to said street at the rear of <br />the residence. <br />6. No outside toilet shall ever be erected or main- <br />tained on any lot in said tract except for temporary <br />use during the time that a building is in process of <br />construction. <br />-3- <br />
