Dane County Land Regulation & Records'.
Room 116, City -County Building
Madison, Wisconsin 53709
November 20, 1989
Robert Pulvermacher
Clerk, Town of Vienna
6499 Beech Court
Waunakee, Wisconsin 53597
RE: FINAL JUDGMENT - VILLAGE OF DEFOREST ANNEXATION, TOWN OF VIENNA
Dear Mr. Pulvermacher,
Land Division Review
608/266-9086
Property Listing
608/266-4120
Surveyor
608/266-4252
Zoning
608/266-4266
Our department has received a copy of the "Final Judgment" regarding Case
#88CV2924 Town of Vienna vs. Village of DeForest. The judgment incorporates
the stipulated agreement between the two municipalities which delineates their
common boundary. The date of this judgment is August 30, 1989.
Please be advised that based on this judgment we are taking the effective date
of the new boundary to be August 30, 1989 and, therefore, it will not cause a
change in the tax rolls for 1989. The change will be reflected in the 1990
tax rolls.
Also please be advised that our review of the description of the boundary line
has disclosed a discrepancy in the area of Lots 8 and 10 of the Evco
Subdivision. The boundary line as described in Exhibit 5 proceeds across the
lots East to West but at a point which is approximately 100 feet South of the
North lot line. We are not certain if this location is correct or if the
boundary should actually follow the North line of the lots. The discrepancy
also causes the next part of the description, S3°-16'-02"E, 567.47 feet, to be
slightly off when correlated to the map.
A copy of the description with the questionable portion yellow highlighted and
a copy of the pertinent section of the map are enclosed for your review.
Please inform us of your findings so that our records will be correct when we
implement the change in the tax rolls in 1990. Thank you.
Very truly yours,
William Fleck
Zoning Administrator
WF/mmt
Enclosure:
