The property is within the town's Agricultural Preservation Area, where development is limited to <br />1 residential dwelling unit or non -farm residence (aka "split") per 35 acres of contiguous land owned as of <br />June 28, 1979. The original farm was owned by Theodore Kelley and totaled approximately 160 acres. A <br />34.5 acre portion of the original fann parcel was rezoned and divided off after June 28, 1979. As per the <br />town's density policy requirement for such situations, this density analysis is based on the amount of land <br />currently owned by Mr. Eberle (--124 acres). Please note there is no net change in the number of splits <br />available by using this method. <br />Based on the town's density policy, it appears that the property is currently eligible for a potential of three <br />(3) total splits, provided the relevant town criteria and standards for siting development can be satisfied. <br />Note that the town counts the separation (splitting) of residences built prior to 1979 toward the density <br />limitation. <br />This density analysis does not guarantee town or county approval of a particular land division, rezone, or <br />development proposal. The Town of Dane Plan Commission and Board of Supervisors review all <br />applications to rezone, and apply interpretations, standards and criteria as set forth in the town land use <br />plan to guide their decisions. Such standards include considerations for soil type, environmental features, <br />site characteristics, compatibility with neighboring uses, proposed location of driveways and utility <br />extensions, and proposed lot size and location. In addition, all rezones are subject to County Board, and <br />Executive approval.
