LISA LANE STANCER, Legal Assistant
MARY J. BENISCH, Legal Assistant
WADDELL OF COLUMBUS, S.C.
LAN WADDELL
Attorney at Law
1345 PARK AVENUE
POST OFFICE BOX 407
COLUMBUS, WI 53925
July 28, 2006
Dane County Planning and Zoning
Attn: Mr. Norbert Scribner
City -County Building
210 Martin Luther King Jr. Blvd.
Madison, WI 53703
RE: Oestreich Property,
Town of Christiana
Dear Mr. Scribner:
OFFICE: (920) 623-1111
FAX: (920) 623-4011
MARSHALL: (608) 655-1313
Our office represents the interest of Jack Oestreich, owner of
real estate located at 1784 State Road 73, Cambridge, WI, Sec. 34 in
the Town of Christiana.
T first became familiar. with the Oestreich family when Jack's
mother, Helen, was issued Citation No. ZT2000-789, and approached my
client, Hans Lein, about purchasing some of his land to correct a lot
line problem which was the basis for the citation. Looking back
through my old files, I found that on July 31, 2002, I faxed Scott
Schroeckenthaler regarding the Oestreich/Lein transaction.
I am enclosing a copy of the deed from Lein Acres to Helen
Oestreich for your reference; for some reason I do not have a recorded
copy in my file. I am also enclosing a copy of the plat of survey
prepared by Dave Riesop which provided the parcel correction. At that
time, I indicated to Mr. Lein that, from my perspective, to the degree
that the Oestreich family had occupied more than their deeded property,
they would have the right to retain that land by adverse possession.
We then went slightly beyond the occupation line and deeded the parcel
to them and to the best of my knowledge that cured the county's
concerns which had been expressed in the citation.
My understanding is that Helen and her husband bought the original
property during the late 1950's, and apparently had an inaccurate view
of what their property lines were at that time. Questions were later
raised by the county by virtue of the citation. It would appear the
Oestreich's responded by acquiring the additional, land necessary from
their neighbor, Hans Lein.. I believe the ultimate conveyance is
consistent with the original correction requested by Mr.
