Their property is <br />located in Section 6 in the Town of Montrose. Their current parcel is approximately 10 acres in <br />size and has a house upon it that is approximately 40 years old. <br />On February 28th, 2005 I met with Scott Schroeckenthaler of the Dane County Zoning <br />Department. The question I had at that time was that the Downs family wanted to purchase <br />approximately 10 acres from the farmer who is the owner of the adjoining property abutting my <br />client's land. That purchase would be part of what the farmer owns. We were informed that <br />from a zoning perspective, in that our total acreage would be approximately 18 acres in size, that <br />we are still underneath the 35 acre exclusive ag zoning in which both parcels are currently <br />designated and it would therefore require a rezoning. <br />Mr. Schroeckenthaler indicated that it would be advisable to contact you and find out <br />whether or not the parcel was a "legal parcel". He indicates that designation might be of <br />significance as to whether or not this adjustment of property lines, creating still only one <br />buildable site just increasing the acreage, would necessitate a certified survey map or not. This <br />also may trigger other questions and requirements from your perspective or the county's as to <br />how to structure this transaction. <br />At this time I am sending you a map that shows the adjoining parcel as being Parcel No. <br />0508-063-8561-5 which lies west of our existing parcel. At this time we are requesting an <br />opinion from you as to whether or not the Downs existing parcel is a legal parcel and an <br />understanding as to what meaning and ramification that may have for the future. <br />
