As you <br />may already know, this parcel was separated from adjacent lands illegally. Back on June 18, <br />2003, the subject parcel was separated from a 1.997 acre parcel that is currently under the <br />ownership of Justin Englehart. <br />Under Dane County Code of Ordinances, Chapter 75, Land Division Regulations, a land division <br />which creates a parcel under 35 acres in size is required to have a certified survey map prepared <br />and approved. The warranty deed violates Dane County Code of Ordinance Section, 75.17. <br />This letter is to notify you that the Zoning Division recognizes this parcel as an illegal parcel of <br />record and is not grandfathered in any way. Therefore, county zoning permits will not be <br />permitted for this parcel until the illegal status is corrected. Other such improvements may be <br />limited as well. <br />In order to correct the situation, a Certified Survey Map will need to be submitted for review and <br />ultimately recorded with the Dane County Register of Deeds office that includes the parcel to the <br />north, which is under the ownership of Englehart.
