The message that I received indicated that your cell phone was not <br />functioning at the time of call. As requested, I have reviewed the November 8, 2005 <br />communication to Henry L. Wegwitz. I find the information contained in that letter <br />to be accurate and complete. <br />However, I add the following information for purposes of clarification: <br />The 15.6 acres land parcel, described in R136/102, Dane County Registry, dated <br />09/27/69, was properly created as a separate legal entity prior to the applicable <br />effective date of the Dane County Land Division Regulations, and prior to the <br />effective date of A-1 Agriculture (Exclusive) Zoning in the Town of Dunn. <br />Accordingly, this 15.6 acres parcel can be separately conveyed, at this time, without <br />a Dane County certified survey map approval, and without a change in zoning <br />classification, pursuant to S.10.16(3)(a), Dane County Code of Ordinances. <br />Any division of this 15.6 acres parcel will require a change in zoning classification, <br />together with a Dane County certified survey map approval. <br />As indicated previously, # 061032199200, described in Document # 4066562, Dane <br />County Registry, dated 06/15/05, was created without the required change in zoning <br />classification and without the required Dane County certified survey map approval. <br />The mere surveying of the 1 acre parcel did not create a valid legal parcel. The <br />warranty deeds of record control the specifics of this discussion. It is apparent that <br />others have reviewed the parcel status issue with you, and they have arrived at the <br />same conclusion that I have. If you continue to disagree with this interpretation, <br />you are advised to consult with legal counsel to support your assertion that the 1 <br />acre parcel is a valid legal parcel of record.
