Dane County Planning & Development <br />Room 116, City -County Building, Madison, Wisconsin 53703-3342 Land Division Review <br />608/266-9086 <br />February 27, 2008 <br />Paulson & Associates, LLC <br />136 West Holum Street <br />DeForest, Wisconsin 53532 <br />Re: # 061012381806 <br />SW1/4 S12 T6N R10E <br />Town of Dunn <br />Dane County <br />Gentlepeople: <br />It is apparent that the subject 5.148 acres land parcel, described in R895/131, Dane <br />County Registry, was properly created as a separate legal entity in accordance with <br />the applicable provisions of the Dane County Land Division Regulations, and prior <br />to the effective date of A-1 Agriculture (Exclusive) Zoning in the Town of Dunn. <br />Accordingly, this 5.148 acres parcel can be separately conveyed, at this time, <br />without a further Dane County certified survey map approval, and without a <br />change in zoning classification, pursuant to S.10.16(3)(a), Dane County Code of <br />Ordinances. <br />It is also apparent that # 061012382314, described in R31741/9, Dane County <br />Registry, was created as a separate entity without a Dane County certified survey <br />map approval and without a change in zoning classification. Nothing in the public <br />record supports a representation that # 061012382314 was legally merged with <br /># 061012381806. The boundary of Certified Survey Map # 2267 will continue to <br />exist in the public record until it has been properly vacated and discontinued. <br />Certified survey map boundaries are vacated and discontinued by recording new <br />certified survey maps, by recording subdivision plats, or by decisions of the Circuit <br />Court. You might be aware of other valid methods to accomplish a merged parcel <br />status, but the mere recording of a warranty deed is not one of them. <br />In conjunction with a proper resolution of the current parcel status, the proposed <br />conveyance can occur by simple warranty deed as a transfer of lands between <br />contiguous ownerships. <br />Thank you for your anticipated patience and for your anticipated cooperation in <br />this matter. <br />Norbert Scribner, Dane County Land Division Review <br />cc: Dennis H.
