The primary purpose for <br />subdivision regulations is to establish concise legal descriptions upon which to base <br />property conveyances. By creating these multiple metes and bounds descriptions <br />the exact opposite results. Property tax listings revert to hodge podge descriptions <br />that benefit no one, including the property owner. <br />Nevertheless, consultants often assert the authority within S.236.45, Wisconsin <br />Statutes to justify the creation of multiple transfers of lands between contiguous <br />ownerships. As it is apparent that this assertion is not universally accepted, many <br />municipalities would require a certified survey map approval in the situation that <br />you have described. It is possible that the Town of Dunn Land Division Regulations <br />would be applicable. <br />Please cite some authority for the suggestion that the common boundary between <br /># 061007188106 and Lot 1, Certified Survey Map # 10789 is vacated by simply <br />recording a warranty deed. The 3.22 acres parcel represents the creation of a new <br />and separate parcel, and is not merged with C.S.M. # 10789. <br />Please consider the use of a certified survey map to accomplish the proposed <br />transactions.
