VOLS <br />407 PACE 56 <br />This mortgage is given to secure the following indebtedness: <br />One Thousand. -----------Dollars payable three years from date hereof <br />with interest thereon until paid, at the rate of f iv a per cent. per annum, payable semi-annually, according <br />to the conditions of one certain promissory note bearing even date herewith, executed by the said <br />,Marry C. Yetherwood <br />• mortgagor to the said mortgagees . <br />The mortgagors agree to pay all taxes and assessments of every kind, ordinary or extraordinary, <br />which may be assessed or levied upon or against said described premises, or upon this mortgage, or the <br />note thereby secured, or upon the mortgage interest in said premises created by this instrument. <br />The mortgagor s agree to cause said premises to be assessed as unincumbered real estate, and in <br />case of the non-performance of any of the agreements herein contained, by said mortgagor to be kept <br />and performed, then it shall be lawful for said mortgagee s , t 1 e i r heirs or assigns, to expend any <br />sum of money necessary to preserve the lien of said mortgagee S upon said premises, in payment of taxes <br />or otherwise, and said mortgagee s , their heirs or assigns, are hereby authorized in the event of <br />the non-performance of any of the above agreements, to grant, bargain, sell and convey said real estate at <br />public auction, and make all needful deeds of conveyance to the purchaser thereof, pursuant to the statutes <br />in such case made and provided, and out of the proceeds arising from said sale to reimburse 'vhe'l <br />for all costs, charges and taxes, which they shall have expended in and about the preservation of <br />said premises, or of any suit to foreclose this mortgage, together with a reasonable sum of money as <br />solicitor's fees. <br />It is understood and agreed by the said mortgagors , that the agreements contained herein shall not <br />be construed to in any wise abrogate or abridge any of the rights and remedies given to a mortgagee under <br />section 2209 of the Statutes of Wisconsin, of x898, and that this instrument shall have all of the force of an <br />instrument drawn in the form set forth in said section. <br />iii Mitnes Ulbereof the said mortgagors havd�ereunto set their hand s and seals this <br />23rd day of February ,A.D.,r9 3-4 <br />Signed and Sealed in Presence of <br />�.... ........... <br />............ <br />......... ....................... <br />%tiate of Misconsin <br />Jitl11E County. ss. <br />Personally came before me this 23rd day of F eb r �, a ry <br />...... _.......... _............................ _......... ..
