<br />W it t n e s s e t h , That the said part ies of the first part, for and in consideration of the 'sun ' of
<br />One Dollar (')1.00) and other valuable considerations,
<br />to them in hand paid by the said part y of the second part, the receipt whereof is hereby confessed
<br />and acknowledged, ha ve given, granted, bargained, sold, remised, released, aliened, conveyed and confirmed, .m,i
<br />by these presents do give, grant, bargain, sell, remise, release, alien, convey and confirm unto the said part y
<br />of the second part, his heirs and assigns forever, the following described real estate, situated in the Coi•nty

<br />A parcel of land situated in Section 17, Township 7 North, Range 9 East, Town of
<br />Madison, County of Dane, State of 'disconsin, described as follows:
<br />A portion of Lot 153, Second Addition to Shorewood, recorded on Page 51 and 51A,
<br />Volume 5 of Plats, further described as Lot 3 of Lot 153 with the following boundaries:
<br />Commencing at the Northeast corner of Lot 153, thence South 520 08' Nest 160.0 Feet
<br />on North boundary of Lot 153; thence South 00 32' 3ast 150.5 Feet; thence on a 30 foot
<br />circle a chord length 39.0 Feet bearing approximately South 500 32' East; thence North
<br />760 58' East to 'Jest boundary line of Lot 153 and University of Wisconsin property; thence
<br />North 00 32' West 256.0 Feet to point of beginning.
<br />Together with ingress and egress over court which is to be paved with concrete of a
<br />minimum width of eight (8) feet by the five (5) parties of the replat of Lot 153, it being
<br />understood and agreed that the buyer of the herein described portion of Lot 153 agrees to
<br />pay his proportionate cost of the preparation and construction of the road to be built on
<br />the eourtway that serves this lot.
<br />Provided 'however, that this deed of conveyance shall be subject to the reservations
<br />and restrictions hereinafter stated, which said reservations and restrictions are to be
<br />construed as covenants ruxining with the land, to -wit:
<br />1. None of said lots shall be conveyed to, used, owned, nor occupied by negroes as
<br />owner or tenant.
<br />2. For a period of twenty-five years from October 1, 1921, Eagle Heights Land Company
<br />shall have the right to require plans for the exterior design of any building or structure
<br />to be erected upon any lot in said plat to be first submitted to and approved by an expert
<br />acceptable to said 3agle Heights Land Company.
<br />3. That for said period of twenty-five years no building on any lot in said plat
<br />shall be used for other than residence purposes without written consent of the Ea�;1e
<br />Heights Land Company.
<br />4. That for said period of twenty-five years no building previously erected alse-
<br />T.si.ere shall be moved upon any lot in said plat.

<br />right of way to be designated by said Eagle Heights Land Corn,palay.
<br />Together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise
<br />appertaining; and all the estate, right, title, interest, claim or demand whatsoever, of the said part ies of the
<br />first part, either in law or equity, either in possession or expectancy of, in and to the above bargained premises, and
<br />their hereditaments and appurtenances.
<br />To Have and to 1 old the said premises as above described with the hereditaments and appurtenances, unto
<br />the said part y of the second part, and to his heirs and assigns FOREVER.
<br />And the said Nicholas J. Schmitz, Ida M. Schmitz, his wife, Joseph V. Reilly, Laura
<br />Vo Reilly, his wife, and Vincent J. Koltes, single, _
<br />for themselves, their heirs, executors and administrators, do covenant, grant, bargain, and agree
<br />to and with the said part y of the second part, his heirs and assigns, that at the time of the ense-aling
<br />and delivery of these presents they are well seized of the premises above described, as of a good, sure,
<br />perfect, absolute and indefeasible estate of inheritance in the law, in fee simple, and that the same are free and clear
<br />from all incumbrances whatever,
<br />and that the above bargained premises in the quiet and peaceable possession of the said part of the second
<br />part, :is heirs and assigns, against all and every person or persons lawfully claiming the whole or any
<br />part thereof, they will forever WARRANT AND DEFEND.
