Bass <br />part y of the second part. <br />fitttess"etij, First, That the said part y of the second part hereby agree and bind S <br />legal representatives, to pay, or cause to be paid to the said part of the first part, <br />heirs and assigns, the sum of Two Hundred (0200.00) Dollars, <br />in the manner following: Fifty (450'.00) 1 jars <br />at the ensealing and delivery hereof: the balance of One Hundred 'i.fty (150 .tu 1 ' <br />Dollars to be paid on or before March 1, 1941; together with interest <br />on said balance at the. rate of Four (4 %) per' cent after November 1, 194 <br />to be paid on said March 1, 1941. <br />,A.D.,19`0 <br />part y of the first part, <br />The said payments to be made to the part y of the first part, at Madison, Wis co ns in <br />and the same being intended to apply, when fully completed, as the purchase money for the following <br />tract, piece or parcel of land, situated in the County of Dane and /State of Wisconsin, to -wit: <br />Lot Six (6) , Block Five (5) , Elmhu.2'st, Village of Monona, <br />according to the recorded plat thereof. <br />This agreement is made subject to the following restrictions; <br />FIRST; The line of any building, or, any part thereof, erected on these <br />premises, except in the case of business places, shall not be nearer to the <br />street than the building line indicated on the recorded plat; <br />SECOND; No residence or place of business shall be erected without a su <br />stantial foundation nor at a cost of less than $3500 Dollars. <br />THIRD: No lot or any building thereon shall be sold or leased to any <br />negro negress, or Italian; <br />FOURTH; No business place shall be .erected except on Lots One (1), Two <br />(2), Three (3), Four (4), Five (5) and Six (6) in Block One (1); <br />All the restrictions as above set forth shall continue until July 1, 19 <br />and shall continue automatically thereafter until the owners of the majorit <br />the net acreage of Elmhurst shall at any time after said date execute and. <br />acknowledge an agreement or agreements in writing releasing Elmhurst or any <br />part thereof from any or all of the above restrictions, and file the same fo <br />record in the Office of the Register of Deeds for Dane County, Wisconsin. <br />termination of any of the above restrictions in the mariner` provided shall i <br />no wise alter restrictions not- so terrminated -- ' <br />It is hereby made an express condition hereof that any owner of land i <br />Elmhurst or any resident of Elmhurst shall be a proper person to do or cause <br />to be done, anything necessary and proper to enforce any or all of the above <br />restrictions. <br />The said part y of the second part further agree Sthat he will pay, when due and pay- <br />able, all taxes and assessments which have been assessed or levied on the above .described premises since <br />the first day of January, A. D., 19 40' , and also all such as may be hereafter assessed or levied thereon, or <br />upon the interest of said part y of the first part in said premises; and also all taxes and assessments <br />now or hereafter assessed or levied against any mortgage which may exist against said premises, or <br />against the note - or the indebtedness secured by such mortgage, or against the interest in said premises <br />of any party holding a mortgage against said premises during the term of this contract, and promise S <br />and agrees that the interest of the part y - of the first part, and the interest of the part y of <br />the second part in said real estate, and the interest of any party holding a mortgage against said real <br />estate, during the term of this contract, shall be assessed for taxation and taxed together, without separate <br />valuation, as-unincumbered real estate, and shall be paid by the said part y of the second part, and <br />the said part y of the second part hereby waive 8 all rights of offsets or deductions because of the <br />payment of any such taxes and assessments, until the aforesaid purchase money shall be fully paid, in the <br />manner above - stated, <br />6, <br />0 <br />
