PETERSEN & SUTHERLAND • <br />"dARRANTY DEED <br />VOL <br />THIS INDENTURE, Made this 26th day of August , <br />in the year of our Lord, one thousand nine hundred and forty -six, <br />between J. M. ALBERS and BELLE K. ALBERS, his wife; WALTER R. BROOKS <br />and RUBY M. BROOKS, his wife; TOM VANZANDEN and MARGARET VANZANDEN, <br />his wife; ROBERT M. RODEN and KATHRIN T. RODEN, his wife, parties of <br />the first part, and TOM VANZANDEN and MARGARET VANZANDEN, husband and <br />wife as joint tenants, parties of the second part. <br />W I T N E S SETH: <br />That the said parties of the first part, for and in consider- <br />ation of the sum of One Dollar and other valuable considerations, to <br />them in hand paid by the said parties of the second part, the receipt <br />whereof is hereby confessed and acknowledged, have given, granted, <br />bargained, sold, remised, released, aliened, conveyed and confirmed, <br />and by these presents do.give, grant, bargain, sell, remise, release, <br />alien, convey and confirm unto the said parties of the second. part, <br />as joint tenants, the following described real estate situated in the <br />County of Dane, Wisconsin, to -wit: <br />Lots One and Two (1 and 2) of Valley Plat in the Vill awe of <br />Shorewood Hills, according to the recorded plat thereof; subject <br />to the following reservations and restrictions for the benefit <br />of all lots in said plat which are to be construed as covenants <br />running with the land, to -wit: (1) None of said lots shall be <br />conveyed to used, owned or occupied by Negroes as owners or <br />tenants; (2) For a period of 25 years from August 14, 1946,.no <br />building or structure shall be erected upon any lot in said plat <br />containing less than 14000 cu.ft., above the bottom of the joists <br />of the first floor at or above ground level; (3) For the said <br />period of 25 years no building on any lot in said plat shall be <br />used for other than single family residence purposes; (4) For <br />the said period of 25 years no building previously erected else- <br />where shall be moved upon any lot in said plat; (5) For the said <br />period of 25 years no more than one dwelling house shall be <br />constructed upon any lot in said plat; (6) During the said 25 <br />year period it is agreed that no windmill be constructed upon <br />any lot in said plat; (7) That during the said 25 year period no <br />barn or outhouse or garage not attached to the main dwelling <br />house as a part thereof, shall be constructed upon said plat or <br />any lot in said plat; (8) Outlot B shall be and hereby is <br />dedicated as and for a public street as an extension to Tally <br />Ho Lane in the Village of Shorewood Hills as of the time when said <br />Tally Ho Lane is extended Westward through the adjoining property <br />to the Nest to a point where it intersects with another street <br />of the Village of Shorewood Hills, and until such dedication is <br />effective said Outlot B shall constitute a part of Lots 7 and 8 <br />of said plat.(except for the purpose of determining any setback <br />or front line of said Lots 7 and 8 under any zoning; ordinance), <br />and title thereto to the center line of Outlot B shall pass with <br />
