S. Highway #12 and 13; thence along North- <br />easterly side of said Highway South 390 401 East 20100 feet; thence <br />continue along said Highway on a 20 031 curve to the left for a <br />distance of 1991.86 feet, the longe chord of which bears South <br />600 031 East 1950.0 feet to the point of beginning. <br />Excepting a strip of land 30,0 feet in width, which begins at the <br />Southeast corner of above described lands; thence Northwesterly <br />along above last mentioned curve (20 031 curve to the left) to a <br />point of intersection with the lot line between Lots 75 and 76, <br />Proposed Plat of Indian Hills. Said parcel being a easement for <br />U. S. Highway #12 and 13. <br />Grantors further convey all their right, title and interest to the <br />center of the highways abutting the above described premises, sub- <br />ject to the highway easement thereon. <br />The above premises are subject to the following reservations and <br />restrictions, to -wit: <br />10 Only members of the Caucasian race shall own, use or occupy <br />any dwelling on said premises, excepting that this covenant <br />shall not prevent occupancy by domestic servants of a differ- <br />ent race employed by an owner or tenant. <br />20 For a period of twenty -five (25) years from September 1,1946, <br />none of the above described real estate shall be used for <br />other than residence purposes, including attached residential <br />garage. <br />3. For a period of twenty -five (25) years from September 1,1946, <br />no building; or structure shall be erected on the above de- <br />scribed real estate unless the plans and exterior design of <br />the same are approved in writing by the majority of a committee <br />originally to consist of Fred Risser, Elizabeth W. Risser, <br />Robert H. R. Benson and Merrill J. Haley, together with an <br />architect of their choice if two members of the committee <br />desire a fifth member. Any of the First four named to the <br />commiteee may designate his successor. The death of a member <br />of the committee or his inability or refusal to act shall be <br />deemed to create a vacancy. If a vacancy exists for 30 days, <br />such vacancy may be filled by the remaining members. The <br />grantors have in mind the eventual creation of a committee <br />of home owners on said premises and adjacent area, and if the <br />committee is not filled as above indicated, it may be filled <br />by the judge of the county court for Dane County. <br />4. For a period of twenty -five ( 25 ) years from September 1,1946, <br />no building previously erected elsewhere shall be moved upon <br />the above described premises unless a majority of the committee <br />approve such action in writing. <br />The foregoing restrictions are imposed for the benefit <br />of the present and future owners of the land hereby <br />conveyed and the land adjacent thereto, and such per- <br />sons shall have 'a right to apply to a court of compe- <br />tent jurisdiction to enjoin any violation (or attempted <br />violation) thereof together with damages for such <br />violation. <br />TOGETHER with all and singular the hereditaments and appur- <br />tenances thereunto belonging or in anywise appertaining; and all <br />the estate, right, title, interest, claim or demand whatsoever, <br />of the said parties of the first part, either in law or equity, <br />either in possession or expectancy of, in and to the above bar- <br />41 e R ises, and their hereditaments and appurtenances, <br />
